Redistricting The Nine City Council Districts In The City Of Albuquerque (Bassan, Peña)

REDISTRICTING THE NINE CITY COUNCIL DISTRICTS IN THE CITY OF ALBUQUERQUE.

BE IT ORDAINED BY THE COUNCIL, THE GOVERNING BODY OF THE CITY OF ALBUQUERQUE:

SECTION 1. FINDINGS. That the Council makes the following findings:

                                          (A)  It is appropriate to redistrict the nine City Council Districts in accordance with Article IV, Section 3, of the City Charter.

                                          (B)  Resolution 21-226 (R-21-226) established a Redistricting Committee to review and make recommendations to the Council regarding redistricting the nine Council Districts.

                                          (C)  The Redistricting Committee used the 2020 Census data for the City of Albuquerque as the basis for recommending changes in Council District boundaries in a manner consistent with constitutional principles governing voting rights, population and other factors, the City Charter, state and federal statutes, and Resolution 21-226 (R-21-226).

                                          (D) The Redistricting Committee Report (OC-22-13) was made available to the public and received by the City Council.

                                          (E)  The Council in formal session did review the recommendation of the Committee.

SECTION 2. COUNCIL DISTRICTS. The attached maps and listing of Council Districts by precincts with total population by district (Exhibit A) is incorporated herein as if set out in full and is hereby adopted as designating and constituting the respective areas of the nine Council Districts.

SECTION 3. CITY CHARTER. Exhibit A does hereby constitute an Appendix to the City Charter in replacement of the present Appendix A to the Charter.

SECTION 4. 2023 ELECTION. That the areas established by Exhibit A as the nine Council Districts are for the purposes of Municipal Elections starting with the 2023 regular local election and all subsequent Municipal Elections until the next redistricting; for all other purposes, the effective date for the Council Districts created by Exhibit A is the effective date of this ordinance.  Each of the current incumbents in the nine Council Districts will remain in office until the expiration of the term to which he or she was elected.

SECTION 5. COMMITTEE REPORT. For the purpose of maintaining records of the activities and recommendations of the Redistricting Committee, the Redistricting Committee Report is hereby received and incorporated herein as if set out in full, via OC-22-13.

SECTION 6. PRECINTS. For the purpose of identifying the precincts in each Council District, a listing of precincts identifying Council Districts by precinct is attached as part of Exhibit A and is incorporated herein as if set out in full and is hereby adopted as to precincts.

SECTION 7. SEVERABILITY CLAUSE. If any section, paragraph, sentence, clause, word or phrase of this Ordinance is for any reason held to be invalid or unenforceable by any court of competent jurisdiction, such decision shall not affect the validity of the remaining provisions of this Ordinance.  The Council hereby declares that it would have passed this Ordinance and each section, paragraph, sentence, clause, word or phrase thereof irrespective of any provision being declared unconstitutional or otherwise invalid.

SECTION 8. COMPILATION. Exhibit ‘A’ shall amend, update and replace Appendix ‘A’ of the Albuquerque City Charter.

SECTION 9. EFFECTIVE DATE. This Ordinance shall take effect five days after publication by title and general summary.
