Establishing A Process For The City Council To Consider Re-Adoption Of The Goals And Policies Of Sector Development Plans Listed In Appendix D Of The Comprehensive Plan Until The First Community Planning Area Assessment Cycle Is Complete And The Comprehensive Plan Is Updated (Benton, Peña)

WHEREAS, the City Council rescinded all Sector Development Plans as of May 18, 2018 when the Integrated development Ordinance (“IDO”) became effective; and
WHEREAS, the City Council adopted an updated Albuquerque-Bernalillo County Comprehensive Plan (“ABC Comp Plan”) on March 20, 2017 via R-16-108 (Enactment No. R-2017-026), including updated policies carried over from adopted Rank 3 Sector Development Plans; and
WHEREAS, the 2017 Albuquerque Bernalillo County Comprehensive Plan (“ABC Comp Plan”) as adopted by the City continues to include Sector Development Plans adopted as of March 2017 in its Appendix ‘D’ so that they can be used as informational, reference documents for relevant sub-areas, especially in creating and/or amending Community Planning Area (“CPA”) assessments in the future; and
WHEREAS, Sector Development Plans, reflect the history of neighborhoods within their boundaries, are “snapshots” of each Sector at the time a Plan was adopted, and are useful and relevant as baselines for collecting data, providing information to residents, receiving input from stakeholders, and framing analyses and recommendations to the Environmental Planning Commission and the City Council; and
WHEREAS, the 2017 ABC Comp Plan’s policies recommend a transition from the old system of long-range planning with communities on an as-needed basis to create standalone Rank 3 plans to a 5-year cycle of planning with each of 12 Community Planning Areas in order to provide opportunities for every area of the city to benefit from area-specific long-range planning, including regular and ongoing opportunities for stakeholder engagement and analysis by staff of trends, performance measures, and progress toward implementation actions in the Comp Plan; and
WHEREAS, the IDO implements this new proactive approach to long-range planning by committing the City to a proactive, equitable system of assessments (§14-16-5-3.3) done every five years with residents and stakeholders in each of 12 Community Planning Areas established by the ABC Comp Plan; and
WHEREAS, the Planning Department will initiate the Community Planning Areas assessments in June 2020 to assess current and anticipated trends and conditions, to understand planning, land use, and transportation issues and develop solutions to address them, and to track progress on performance measures identified in the ABC Comp Plan over time; and
WHEREAS, the Planning Department will provide opportunities for community members in each Community Planning Area to give input during the process of designing the assessment process prior to June 2020; and
WHEREAS, the Planning Department will provide opportunities for community members in each Community Planning Area to participate during the 16-week assessment; and
WHEREAS, the Environmental Planning Commission and the City Council will review and accept recommendations in assessment reports for each of the City’s 12 Community Planning Areas over a 5 year cycle; and
WHEREAS, recommendations for updates to policies in the ABC Comp Plan will be incorporated into the next update of the ABC Comp Plan.
BE IT RESOLVED BY THE COUNCIL, THE GOVERNING BODY OF THE CITY OF ALBUQUERQUE:
Section 1. Adoption of Sector Development Plan Polices. The Planning Department shall prepare an amendment to the ABC Comp Plan, and process the amendment pursuant to the provisions of IDO Section 14-16-6-7(A). This amendment shall propose to adopt goals and policies for the twelve designated Community Planning Areas identified in ABC Comp Plan Section 4-3 (and Figure 4-3), only as appropriate to and coterminous with the geographic scope of the respective Sector Development Plans, which goals and policies shall remain in place as part of the ABC Comp Plan CPA policies until such time as the City Council adopts updated policies for the respective CPA as part of the five-year ABC Comp Plan process.
Section 2. SEVERABILITY CLAUSE. If any section, paragraph, sentence, clause, word or phrase of this resolution is for any reason held to be invalid or unenforceable by any court of competent jurisdiction, such decision shall not affect the validity of the remaining provisions of this resolution. The Council hereby declares that it would have passed this resolution and each section, paragraph, sentence, clause, word or phrase thereof irrespective of any provisions being declared unconstitutional or otherwise invalid.
