C/S Amending The Composition Of The Board Of Housing Commissioners For The Albuquerque Housing Authority (Peña, Benton)

WHEREAS, R-10-97 (Enactment No. R-2010-145) established the current Board of Housing Commissioners to be responsible for the operation of the Albuquerque Housing Authority; and
WHEREAS, presently all members of the Board are appointed by the Mayor with the advice and consent of City Council; and
WHEREAS, the City Council has an inherent interest in housing matters; and
WHEREAS, adding members to the Board will allow greater input from the community into the operations of the Albuquerque Housing Authority.
BE IT RESOLVED BY THE COUNCIL, THE GOVERNING BODY OF THE CITY OF ALBUQUERQUE:
SECTION 1. Subsections ‘5(A)’ and ‘5B’ of R-10-97 (Enactment No. R-2010-97) are hereby amended as follows:
“SECTION 5. BOARD OF HOUSING COMMISSIONERS
A. Establishment: There is hereby established a Board of Housing Commissioners for the Albuquerque Housing Authority. The Board of Housing Commissioners [will assume responsibility is responsible] for operation of the Housing Authority [on July 1, 2011]. The Board of Housing Commissioners is composed of [five (5)] [seven (7)] members who shall be residents of the City of Albuquerque, but not current employees or officers of the City of Albuquerque. At least one member shall have experience in residential construction, real estate development or management. At least one other member shall be a CPA. At all times, at least one member of the Board shall be a resident of a low rent Public Housing Program dwelling unit owned by the Albuquerque Housing Authority, [or an Albuquerque Housing Authority Section 8 Housing program resident,] who shall be called the Resident Commissioner. Termination of the Dwelling Lease of the Resident Commissioner shall result in their immediate removal from the Board of Housing Commissioners. For any member of the Board, termination of their residency inside the City Limits of Albuquerque shall result in their immediate removal from the Board of Housing Commissioners.
B. Appointments: [the The Mayor shall appoint the three members possessing the member-specific qualifications identified above, one regular] member[s] and [a] chairperson of the Board of Housing Commissioners [shall be appointed by the Mayor] with the advice and consent of the City Council. [Two additional regular members shall be selected by the City Council and presented to the Mayor for appointment.] [Of the original members of the Board, one shall be appointed to a one (1) year term, another to a two (2) year term, another to a three (3) year term, another to a four (4) year term, and the last member shall be appointed to a five (5) year term. Thereafter, all All] members shall be appointed to five (5) year terms ending on December 1st, except that all vacancies shall be filled for the unexpired term. A commissioner shall hold office until a successor has been appointed and has qualified, unless sooner removed according to law. A commissioner may serve a maximum of two successive terms of office. The members of the Board may elect their own chairperson.”
SECTION 2. SEVERABILITY CLAUSE. If any section, paragraph, sentence, clause, word or phrase of this Ordinance is for any reason held to be invalid or unenforceable by any court of competent jurisdiction, such decision shall not affect the validity of the remaining provisions of this Ordinance. The Council hereby declares that it would have passed this Ordinance and each section, paragraph, sentence, clause, word or phrase thereof irrespective of any provision being declared unconstitutional or otherwise invalid.
