Amending Bill number R-13-220, Enactment number R-2013-114, titled: Establishing a policy for the timeframes for purging of license plate reader records by the Albuquerque Police Department; to extend the time period the albuquerque police department may keep information from license plate readers before purging the information.

                     WHEREAS, the Albuquerque Police Department (“APD”) employs license plate readers that record a still image of vehicle license plates and location information from vehicles parked or driving in a public location; and

WHEREAS, license plate images and location data can assist in legitimate police activity, including but not limited to locating missing persons and stolen vehicles; and

WHEREAS, the license plate images are in a format that allows storage and archiving of the images for indefinite periods of time; and

                     WHEREAS, the City Council previously passed a resolution restricting APD’s access to the information gathered from license plate readers, requiring APD to purge such information after fourteen days; and

                     WHEREAS, APD can more effectively locate missing persons and stolen vehicles if permitted to access the information gathered from license plate readers for a longer period of time.

Be it resolved by the Council, the Governing body of the City of Albuquerque:

                     SECTION 1. Section 1 of R-13-220, Enactment Number R-2013-114, page one, lines 19 to 24, are replaced with the following language:

                     It shall be the policy of the City that the Albuquerque Police Department shall purge each license plate image and all associated information from its databases within one (1) year from the date of collection unless a longer period of retention is required for a particular license plate image, images or information because of an ongoing criminal investigation.
