Amending § 1-16-1 Of The City Of Albuquerque Code Of Resolutions To Adopt A Citywide Rank 2 Bikeway And Trail Facilities Plan (2024) And Repeal The Bikeways & Trails Facility Plan (2015) (Baca, by request)

WHEREAS, the City Council, the governing body of the City of Albuquerque, has the authority to adopt facility plans to promote the health, safety, and general welfare of the residents of Albuquerque, pursuant to NMSA 1978, Sections 3-19-1 et. seq., and by its home rule powers; and
WHEREAS, people use both bikeways and trails for a variety of activities, including recreation, commuting, exercise, and utilitarian travel; and
WHEREAS, the City Council adopted the 2015 Bikeways & Trails Facility Plan on May 18, 2015 via R-14-142 (Enactment R-2015-045), which replaced the 1993 Trails & Bikeways Facility Plan and the Comprehensive On-Street Bicycle Plan (2000); and
WHEREAS, the 2024 Bikeway and Trail Facilities Plan focuses on projects that are plausible in the near term-pending available funding and staff resources-and provides a roadmap for the City to build out a dense network of high-comfort facilities that connects to everyday destinations; and
WHEREAS, the 2024 Bikeway and Trail Facilities Plan creates useful and comfortable connections and encourages more people to choose bicycling as a mode of transportation, creating a virtuous cycle where drivers become more cognizant of bicyclists and safety increases; and
WHEREAS, the 2024 Bikeway and Trail Facilities Plan is an opportunity to create consistency and alignment with these recently adopted plans and policies and ensure the Bikeway and Trail Facilities Plan serves as a mechanism to implement goals and policies identified in the Albuquerque/Bernalillo County Comprehensive Plan; and
WHEREAS, the 2024 Bikeway and Trail Facilities Plan is consistent with the applicable goals and policies of the Albuquerque/Bernalillo County Comprehensive Plan, Complete Streets Ordinance, Vision Zero Action Plan and Year in Review, Climate Action Plan, and other regional planning documents and programs; and
WHEREAS, on July 18, 2024, the Environmental Planning Commission (EPC), in its advisory role, voted to forward a Recommendation of Approval to City Council for Project # 2024-010493, Case # RZ-2024-00032, a request for an Adoption of a Rank 2 2024 Bikeway and Trail Facilities Plan, with Findings #1-17, which include an analysis of applicable goals and policies from the Comp Plan, and Recommended Conditions of Approval #1-6 in the Official Notice of Decision.
BE IT RESOLVED BY THE COUNCIL, THE GOVERNING BODY OF THE CITY OF ALBUQUERQUE:
SECTION 1. Section 1-16-1 of the Albuquerque Code of Resolutions, The 2015 Bikeways & Trails Facility Plan is repealed in its entirety.
SECTION 2. In order to implement the policies of the Albuquerque/Bernalillo County Comprehensive Plan, applicable City Rank 2 and Rank 3 Plans, and the Mid-Region Council of Government’s Metropolitan Transportation Plan, the 2024 Bikeway & Trail Facilities Plan, attached hereto as Exhibit A, is hereby adopted. A new Section 1-16-1 of the Albuquerque Code of Resolutions is adopted as follows:
§ 1-16-1 BIKEWAY & TRAIL FACILITIES PLAN
(A) The City Council adopts the EPC’s Findings #1-17 and Conditions of Approval #1-6 related to the 2024 Bikeway & Trail Facilities Plan.
(B) The City Council adopts the following additional findings:
(1) The Rank 2 2024 Bikeway and Trail Facilities Plan updates, consolidates, and replaces the Bikeways & Trails Facility Plan (2015). Rank 2 Facility Plans describe existing facilities, policies, recommendations, and proposed projects.
(2) The scope of the 2024 Bikeway and Trail Facilities Plan is citywide. It also shows trails within Bernalillo County’s jurisdiction to demonstrate regional connectivity that are not included as proposed City projects.
(3) The purpose of the plan is to ensure a well-connected, enjoyable, and safe non-motorized transportation and recreation system throughout the metropolitan area. Updating the Plan is a reasonable exercise in local self-government consistent with the City Charter.
(4) The Albuquerque/Bernalillo County Comprehensive Plan, the Integrated Development Ordinance, the Complete Streets Ordinance, Vision Zero Action Plan and Year in Review, and Climate Action Plan are incorporated herein by reference and made part of the record for all purposes.
(5) The plan is generally consistent with the key themes of the Connections: 2040 Metropolitan Transportation Plan (MTP) through its multi-modal vision, policies, and proposed facilities for pedestrians and cyclists throughout the city. The proposed facility map is consistent with the current Long Range Bicycle System (LRBS) map and will provide updates to the LRBS map when it is amended for the Transitions 2045 MTP.
(6) Key City Departments, including Municipal Development, Parks & Recreation, and Planning, coordinated as part of this facility planning effort.
(7) There is general support among the reviewing agencies and members of the public that the City should adopt the proposed Bikeway and Trail Facilities Plan.
SECTION 3. COMPILATION. SECTIONS 1 and 2 of this Resolution amends, is incorporated in, and is to be compiled as part of the City of Albuquerque Code of Resolutions, § 1-16-1.
SECTION 5. SEVERABILITY CLAUSE. If any section paragraph, sentence, clause, word, or phrase of this resolution is for any reason held to be invalid or unenforceable by any court of competent jurisdiction, such decision shall not affect the validity of the remaining provisions of this resolution. The Council hereby declares that it would have passed this resolution and each section, paragraph, sentence, clause, word or phrase thereof irrespective of any provisions being declared unconstitutional or otherwise invalid.
