CONCERNING THE LOCAL ELECTION TO BE HELD IN THE CITY OF ALBUQUERQUE ON NOVEMBER 7, 2023.

                     WHEREAS, a Regular Local Election is required to be held in the City of Albuquerque on Tuesday the 7th day of November, 2023, pursuant to City Charter Article II, Section 2, at which election the offices of City Councilor for Districts 2, 4, 6, and 8 will be filled.

BE IT RESOLVED BY THE COUNCIL, THE GOVERNING BODY OF THE CITY OF ALBUQUERQUE:

SECTION 1.  A Regular Local Election shall be held in Albuquerque, New Mexico on Tuesday, November 7, 2023 (the “Regular Local Election”). In the event that a Run-Off Election is necessary, it will be held on Tuesday, December 12, 2023.

SECTION 2.  At this election the office of four (4) City Councilors shall be elected, one to represent each of the following Council Districts for a four (4) year term beginning on January 1, 2024: 2, 4, 6, and 8.  The boundaries of each Council District are identified by the precincts listed in Appendix A of the Albuquerque City Charter.

SECTION 3.  Persons submitting petitions in accordance with Article II, Section 4 of the City Charter, for the Office of Councilor candidate are required to file such petitions in the Office of the City Clerk beginning at 8:00 a.m. on June 5, 2023 and no later than 5:00 p.m. on July 10, 2023.                     

SECTION 4.  The City Clerk shall file the declaration of candidacy for publicly financed City Council candidates on July 24, 2023. A candidate for office, or their representative, shall file a declaration of candidacy for privately financed candidates in the Office of the County Clerk between the hours of 8:00 a.m. and 5:00 p.m. on Tuesday, August 29, 2023.

SECTION 5.  Write-in candidates for the office shall file a declaration of write-in candidacy on September 5, 2023 before 5:00 p.m. at the Office of the County Clerk.  The ballot for each position where there is a declared write-in candidate shall contain a space for a qualified elector to write-in the name of one declared write-in candidate and such space shall be identified as, “declared write-in candidate”.

SECTION 6.  Questions to be submitted to the voters, if any, shall be authorized by separate resolution of the City Council.

SECTION 7.  The polls for this election shall open at 7:00 a.m. and shall close at 7:00 p.m. on November 7, 2023. 

SECTION 8.  Absentee shall be administered by the Bernalillo County Clerk as authorized by law. Eligible voters may request applications for absentee ballots from the Office of the County Clerk, One Civic Plaza, NW 6th Floor, Albuquerque, New Mexico.  Eligible voters may also request an application for an absentee ballot in person, via email to clerk@bernco.gov, or by calling (505) 243-VOTE (8683), option 2. The County Clerk may issue absentee ballots to approved applicants beginning on October 10, 2023. Absentee ballots must be received by the County Clerk through the mail or by hand delivery no later than 7:00 p.m. November 7, 2023, the day of the election.

SECTION 9.  Early Voting shall be administered by the Bernalillo County Clerk as authorized by law. Early Voting shall begin on Saturday, October 21, 2023 and end on Saturday, November 4, 2023 at the Office of the County Clerk and the other designated Early Voting Locations as designated by the County Clerk.  Early Voting shall take place during the hours of 7:00 a.m. and 7:00 p.m.

SECTION 11.  The officers and agents of the City are hereby authorized and directed to take all action necessary or appropriate to effectuate the provisions of this Resolution, including but not limited to providing this Resolution to the Bernalillo County Clerk and cooperating with the Bernalillo County Clerk and the New Mexico Secretary of State regarding all election matters including but not limited to the completion of any memorandums of agreement as may be required, the preparation of affidavits, instructions and election supplies, and the publication of notices. To the extent that financial participation for covering the cost of the election is requested of the City, the City Council will consider any such appropriation through separate action.

SECTION 12.  SEVERABILITY CLAUSE. If any section, paragraph, sentence, word, or phrase of this resolution is for any reason held to be invalid or unenforceable by any court of competent jurisdiction, such decision shall not affect the validity of the remaining provisions of this resolution.  The Council hereby declares that it would have passed this resolution and each section, paragraph, sentence, word or phrase thereof irrespective of any provision being declared unconstitutional or otherwise invalid.
