DIRECTING THE CITY ADMINISTRATION TO DEVELOP A PILOT PROGRAM UTILIZING NOISE CAMERAS FOR AUTOMATED VEHICLE NOISE ENFORCEMENT.
WHEREAS, Excessive vehicle noise due to modified exhaust systems is causing a nuisance to residents city-wide, negatively impacting the quality of life with unnecessary noise pollution; and
WHEREAS, Excessive vehicle noise is in violation of the Code of Ordinances, Vehicles Nuisance Ordinance, Section 7-10-3 (E) and New Mexico State statute 66-3-844; and
WHEREAS, New technology is available that allows cameras to capture vehicle information based on noise levels as they drive by, similar to automated speed cameras; and
WHEREAS, The City of Albuquerque has already implemented an automated mobile speed enforcement initiative to help address the issue of reckless driving and street racing and can similarly do so to combat excessive vehicle noise; and
WHEREAS, Other cities in the U.S. have piloted or implemented automated noise camera enforcement programs. These include Knoxville, TN, New York, NY, and Longmont, CO; and
WHEREAS, Noise cameras can provide the police department the ability to focus on higher-priority calls as opposed to excessive vehicle noise violations; and
WHEREAS, conducting an automated vehicle noise pilot program can provide data on the effectiveness and viability for the City to consider full implementation.
BE IT RESOLVED BY THE COUNCIL, THE GOVERNING BODY OF THE CITY OF ALBUQUERQUE:
