Urging The New Mexico State Legislature To Repeal The New Mexico Rent Control Prohibition (Fiebelkorn)

WHEREAS, New Mexico is a large state comprised of vastly differing communities which have their own unique housing issues and needs; and
WHEREAS, Albuquerque is by far the largest and most populated municipality in the State, with its population being almost five times that of the next largest city in the State, and it has unique housing needs outside of the scope of other cities and towns in New Mexico because of its urban make-up and large population; and
WHEREAS, a housing crisis in large cities in the State of New Mexico and throughout the Nation is causing an unprecedented number of people to be homeless or precariously housed; and
WHEREAS, since the COVID-19 Pandemic began in March of 2020, rental housing costs in Albuquerque have risen at unprecedented rates; and
WHEREAS, the growing population of homeless and precariously housed people in the State constitutes a housing crisis, which local governments must have some freedom in finding policies to create housing solutions; and
WHEREAS, New Mexico State Statute NMSA 1878, ? 47-8a-1, the "Rent Control Prohibition," purports to govern all localities in the state; and
WHEREAS, housing is an issue of local concern, and local governments need the ability to impose landlord-tenant laws that are appropriate for their specific locality, whether it is rural or urban in nature.
BE IT MEMORIALIZED BY THE COUNCIL, THE GOVERNING BODY OF THE CITY OF ALBUQUERQUE:
SECTION 1. The Albuquerque City Council urges the New Mexico State Legislature to repeal NMSA 1878, ? 47-8a-1, the "Rent Control Prohibition."
