Amending Articles II, IV, XII, XIII, And XIV Of The City Charter Relating To Elections And Public Campaign Financing (Davis, Pe?a, Bassan, by request)

WHEREAS, changes to the local election act require removing references to management of elections that the City no longer maintains; and
WHEREAS, additional clarifications around campaign finance reporting requirements are necessary to ensure clarity and transparency; and
WHEREAS, the 2021 election cycle highlighted the need for updates to the Open and Ethical Election Code to ensure continued participation and compliance; and
WHEREAS, Article II, IV, XII, XII, and XIV allow the Council to amend by ordinance adopted by a majority plus two of the entire membership of the council voting in favor of such amendment or amendments.
BE IT ORDAINED BY THE COUNCIL, THE GOVERNING BODY OF THE CITY OF ALBUQUERQUE:
SECTION 1. Article II of the City Charter is amended as follows and shall be renumbered accordingly:
Section 1. CHARTER ELECTION LAWS.
Article II, Elections, Article XIII, Election Code, and Article XVI, Open and Ethical Elections Code, [and NMSA 1978, Chapter 1] all govern elections in Albuquerque. Article II sets forth candidate qualifications, governing law, and the non-partisan election process. Article XIII establishes campaign reporting requirements, contribution limitations, and the regulation of campaign practices by the Board of Ethics. Article XVI allows candidates to run for office with public financing. Candidates may choose to run for office with either public financing or private financing.
