CONCERNING THE LOCAL ELECTION TO BE HELD IN THE CITY OF ALBUQUERQUE ON NOVEMBER 2, 2021.

                     WHEREAS, a Regular Local Election is required to be held in the City of Albuquerque on Tuesday the 2nd day of November, 2021, pursuant to City Charter Article II, Section 2, at which election the offices of Mayor and City Councilor for Districts 1, 3, 5, 7, and 9 will be filled.

BE IT RESOLVED BY THE COUNCIL, THE GOVERNING BODY OF THE CITY OF ALBUQUERQUE:

SECTION 1.  A Regular Local Election shall be held in Albuquerque, New Mexico on Tuesday, November 2, 2021 (the “Regular Local Election”). In the event that a Run-Off Election is necessary, it will be held on Tuesday, December 7, 2021.

SECTION 2.  At the election on November 2, 2021, the Offices of Mayor and five (5) City Councilors shall be elected, one City Councilor to represent each of the following Council Districts for a four (4) year term beginning on January 1, 2022: 1, 3, 5, 7, and 9.  The boundaries of each Council District are identified by the precincts listed in Appendix A of the Albuquerque City Charter.

SECTION 3.  Persons seeking to run for the Office of Mayor as a publicly financed candidate are required to file petitions in accordance with Article II, Section 4 of the City Charter between 8:00 a.m. April 17, 2021 and 5:00 p.m. June 19, 2021, and those running as a privately financed candidate were required to file a petition between 8:00 a.m. June 8, 2021 and 5:00 p.m. August 10, 2021.  Persons seeking to run for an Office of City Councilor as a publicly financed candidate were required to submit petitions in accordance with Article II, Section 4 of the City Charter between 8:00 a.m. May 31, 2021 and 5:00 p.m. July 5, 2021, and those running as a privately financed candidate are required to file a petition between 8:00 a.m. July 6, 2021 and 5:00 p.m. August 10, 2021.                     

SECTION 4.  The City Clerk shall file the declarations of candidacy for publicly financed Mayoral candidates with the Office of the County Clerk not later than June 23, 2021, and for publicly financed City Council candidates not later than July 9, 2021. Privately financed candidates, or their representatives, shall file a declaration of candidacy in the Office of the County Clerk between the hours of 8:00 a.m. and 5:00 p.m. on Tuesday, August 24, 2021 as provided by law.

SECTION 5.  Write in candidates for the office shall file a declaration of write in candidacy at the Office of the County Clerk before 5:00 p.m. on August 31, 2021.  The ballot for each position where there is a declared write in candidate shall contain a space for a qualified elector to write in the name of one declared write in candidate and such space shall be identified as, “declared write-in candidate”.

SECTION 6.  Questions to be submitted to the voters, if any, shall be authorized by separate resolution of the City Council.

SECTION 7.                     All persons desiring to vote at this election shall be registered to vote within the City of Albuquerque.  Any person who is otherwise qualified to vote and who is not currently registered may register at the office of the Bernalillo County Clerk as provided by law.

SECTION 8.  The polls for this election shall open at 7:00 a.m. and shall close at 7:00 p.m. on November 2, 2021. 

SECTION 9.  Absentee ballots shall be administered by the Bernalillo County Clerk as provided by law.

SECTION 10.  Early Voting shall be administered by the Bernalillo County Clerk at Early Voting locations and during hours designated by the County Clerk, as provided by law.

SECTION 11.  For further information concerning this election, the public may contact the Office of the City Clerk, 600 2nd Street NW, Albuquerque, New Mexico, by email at cityclerk@cabq.gov <mailto:cityclerk@cabq.gov> and online at www.cabq.gov/clerk <http://www.cabq.gov/clerk>.

SECTION 12.  The officers and agents of the City are hereby authorized and directed to take all action necessary or appropriate to effectuate the provisions of this Resolution, including providing this Resolution to the Bernalillo County Clerk and cooperating with the Bernalillo County Clerk and the New Mexico Secretary of State regarding all election matters, including the completion of any memorandums of agreement as may be required, the preparation of affidavits, instructions and election supplies, and the publication of notices.  To the extent that financial participation for covering the cost of the election is requested of the City, the City Council will consider any such appropriation through separate action.

SECTION 13.  SEVERABILITY CLAUSE.  If any section, paragraph, sentence, word, or phrase of this resolution is for any reason held to be invalid or unenforceable by any court of competent jurisdiction, such decision shall not affect the validity of the remaining provisions of this resolution.  The Council hereby declares that it would have passed this resolution and each section, paragraph, sentence, word or phrase thereof irrespective of any provision being declared unconstitutional or otherwise invalid.
