BE IT ORDAINED BY THE COUNCIL, THE GOVERNING BODY OF THE CITY OF ALBUQUERQUE:
SECTION 1. FINDINGS
The City Council finds that:
(A) There are capital improvement needs within communities and areas of the City that may be more urgent, due to consideration of issues such as poverty, race, equal access, opportunity, density, and development history.
(B) Additional guidance and tools are necessary to guide the development of the City's Capital Plan to ensure that the needs of underserved communities are met.
(C) A specific amount of recurring capital funding is necessary for the City to begin to meet the needs of the underserved areas.
SECTION 2. A new subsection (Q) is added to ?2-12-1 CAPITAL
IMPROVEMENTS PROGRAM INTENT; SCOPE as follows:
"(Q) Two percent of the General Obligation Bond Program shall be reserved for improvements in underserved areas and communities of the City. Assignment of specific projects using this set-aside allocation shall be done in consultation with the resources and tools provided by City's Office of Equity and Inclusion, as they relate to social vulnerabilities such as poverty and race."
SECTION 3. SEVERABILITY CLAUSE. If any section, paragraph, sentence, clause, word or phrase of this ordinance is for any reason held to be invalid or unenforceable by any court of competent jurisdiction, such decision shall not affect the validity of the remaining provisions of this ordinance.
