ORDINANCE

Prohibiting Persons From Interfering With Or Impeding The City’s Enforcement Of Public Health Laws, Orders Or Restrictions (Benton, Borrego)

BE IT ORDAINED BY THE COUNCIL, THE GOVERNING BODY OF THE CITY OF ALBUQUERQUE:

                     SECTION 1.                     Enacting a new Article, “Article 23”, within Chapter 9, “Health, Safety, and Sanitation”, of the Revised Ordinances of Albuquerque, as follows:

“[§ 9-23-1                     INTERFERING WITH OR IMPEDING THE ENFORCEMENT OF PUBLIC HEALTH REQUIREMENTS PROHIBITED.                     No person shall knowingly obstruct, impede with, or interfere with any City employee’s, officer’s or agent’s enforcement of any public health laws, orders or restrictions.

§ 9-23-2                     PENALTY.  Any person convicted of a violation of this Article is guilty of a misdemeanor and is subject to the penalty provisions set forth in § 1-1-99 of this code of ordinances.]”

                     SECTION 2.  SEVERABILITY.  If any section, paragraph, sentence, clause, word or phrase of this Ordinance is for any reason held to be invalid or unenforceable by any court of competent jurisdiction, such decision shall not affect the validity of the remaining provisions of this Ordinance.  The Council hereby declares that it would have passed this Ordinance and each section, paragraph, sentence, clause, word or phrase thereof irrespective of any provision being declared unconstitutional or otherwise invalid.

                     SECTION 3.  COMPILATION. Section 1 of this Ordinance shall amend, be incorporated in and complied as part of the Revised Ordinances of Albuquerque, New Mexico, 1994.

                     SECTION 4.  EFFECTIVE DATE.  This ordinance is passed as an emergency measure and takes effect immediately upon publication by title and general summary.
