Amending R-17-233, Enactment Number R-2017-095, To Extend The Effective Date Of The Interim Procedures While The Neighborhood Association Recognition Ordinance Is Updated (Benton)

AMENDING R-17-233, ENACTMENT NUMBER R-2017-095, TO EXTEND THE EFFECTIVE DATE OF THE INTERIM PROCEDURES WHILE THE NEIGHBORHOOD ASSOCIATION RECOGNITION ORDINANCE IS UPDATED.
WHEREAS, the City’s Neighborhood Association Recognition Ordinance (NARO) provides a vehicle for the City to recognize neighborhood associations for the purpose of notifying associations about proposed City actions that may impact their neighborhood; and
WHEREAS, the provisions of the NARO do not have the scope or enforceability mechanisms to prevent the formation of new neighborhood associations that may create discord within the community and divide neighborhoods, which is contrary to the intent of the program; and
WHEREAS, R-17-233, Enactment Number R-2017-095, was approved by the Council on October 12, 2017 for the purpose of temporarily halting the formation of new recognized or non-recognized neighborhood associations with overlapping boundaries while the city evaluated the existing NARO and potential amendments thereto; and
WHEREAS, R-17-233, Enactment Number R-2017-095, and the associated temporary halt on the formation of new associations expires on December 31, 2020; and
WHEREAS, the temporary halt of new recognized or non-recognized neighborhood associations may limit associations in areas where coalitions are the only association and their bylaws may restrict participation; and
WHEREAS, the Office of Neighborhood Coordination is still in the process of working toward an improved NARO, and has completed the Neighborhood Engagement Process in order to develop a series of recommendations to support the update of the NARO; and
WHEREAS, a draft of a revised NARO is near completion, and it is the sponsor’s intent to distribute the draft to neighborhood associations and coalitions city-wide by the end of the calendar year for input prior to introduction at City Council in early 2021; and
WHEREAS, new recognized and non-recognized associations should be allowed to form under certain circumstances during the update process; and
WHEREAS, in order to grant additional time for public review of the draft NARO, the expiration date of R-17-233, Enactment Number R-2017-095 needs to be extended.
BE IT RESOLVED BY THE COUNCIL, THE GOVERNING BODY OF THE CITY OF
ALBUQUERQUE:
SECTION 1. In Section 3 of R-17-233, Enactment Number R-2017-095, on page 2 line 23 strike December 31, 2020 and replace with June 30, 2021 so that the section is amended to read as follows:
This resolution expires upon the sooner of the next enactment to amend the NARO in relation to the establishment of neighborhood associations or June 30, 2021.
