DELAYING THE IMPLEMENTATION OF ORDINANCE O-20-12 FOR A TIME PERIOD OF TWO MONTHS TO ALLOW TIME FOR THE CORRECTION OF CERTAIN ADMINISTRATIVE ITEMS ASSOCIATED WITH THE BILL.

                     WHEREAS, on August 3rd, 2020 the City Council approved O-20-12, an update to the City’s Uniform Administrative Code; and

WHEREAS, that bill repealed the Uniform Administrative Code (UAC) in its entirety and replaced only certain sections of the UAC; and

WHEREAS, sections related to the administration of the UAC including the issuance, appeal, and inspection of building permits in the City Limits must be added to the UAC to ensure permits are processed in a timely manner; and

WHEREAS, delaying the implementation of O-20-12 for a time period of two months will allow the City time to enact a new ordinance related to the administration of the UAC including the issuance, appeal, and inspection of building permits in the City Limits.

BE IT RESOLVED BY THE COUNCIL, THE GOVERNING BODY OF THE CITY OF

ALBUQUERQUE:

SECTION 1. DELAY OF IMPLEMENTATION

The changes to the Uniform Administrative Code as accepted by the City Council via O-20-12 shall not be implemented until November 9th, 2020.

SECTION 2. ENFORCEMENT OF UNIFORM ADMINISTRATIVE CODE

The Planning Department shall continue to accept and enforce permits to be compliant with the Uniform Administrative Code that was in effect prior to August 3, 2020.

SECTION 3. CREATION OF ORDINANCE

Council Planning Staff and Planning Department staff shall draft an ordinance that is limited to the administrative sections necessary to implement O-20-12 and shall not propose technical additions.
