REQUIRING EMPLOYERS TO PROVIDE AND REQUIRE FACE MASKS FOR EMPLOYEES; REQUIRING NOTICE THAT EMPLOYEES, CUSTOMERS AND THIRD PARTIES MUST WEAR FACE MASKS.
WHEREAS, on March 11, 2020, Governor Michelle Lujan Grisham issued Executive Order 2020-004, Order Declaring a State of Public Health Emergency relating to the spread of COVID-19; and
WHEREAS, the latest amendments to the COVID-19 Public Health Order issued by Governor Lujan Grisham allow certain businesses to open at partial capacity, while following the social distancing and preventative measures summarized in the publication "All Together New Mexico, COVID-safe Practices for Individuals and Employers"; and
WHEREAS, one of the preventative measures identified in the most recent public health order of June 1, 2020, states that "[u]nless a healthcare provider instructs otherwise, all individuals shall wear a mask or multilayer cloth face covering in public settings except when eating, drinking, or exercising" which requirement extends to employees performing services for their employers; and
WHEREAS, even though this preventative measure instructs employers to have their employees wear face coverings, it does not instruct employers to provide their employees with face coverings and at no cost, or to post notice to the public; and
WHEREAS, the gap in these instructions and their enforcement leaves employees at risk of not having the supplies necessary to safely perform their duties in compliance with public health orders; and
