AMENDING SECTION 9-2-3-16, THE “PERMIT FEES” SECTION OF THE HEART ORDINANCE, TO ADD LANGUAGE REGARDING MICROCHIPPING, SPAYING AND NEUTERING FEES, REMOVING LANGUAGE PERTAINING TO THE HEART ORDINANCE FUND AND AMENDING A SINGLE DEFINITION. 

BE IT ORDAINED BY THE COUNCIL, THE GOVERNING BODY OF THE CITY OF ALBUQUERQUE:

                     Section 1. ROA 1994 § 9-2-1-4 “DEFINITIONS” is amended to change the following definition; all other definitions remain unless specifically repealed or amended therein:

                     ALBUQUERQUE ANIMAL CARE CENTER or AACC.  Any City of Albuquerque Animal Welfare Department (AWD) premises, locations or buildings designated as suitable by the Mayor for the care, custody and maintenance of Animals seized by the City.

Section 2. ROA 1994 § 9-2-3-16 “PERMIT FEES” is amended as follows:

§ 9-2-3-16 PERMIT FEES. 

(A)                     60% of all net Permit fees collected under the HEART Ordinance and 60% of fees for microchipping, spaying and neutering performed by the City, shall be dedicated exclusively to programs for the free microchipping and the free spaying and neutering of Companion Animals for Low Income Persons, Moderate Income Persons, Seniors and when possible, the general public. All fees listed in this article are a minimum fee amount and may be increased administratively by the Mayor.

(B)                     Permit Fees.

(1)                     Intact Companion Animal Permit fee is $150 per animal.

(2)                     Litter Permit fee is $150 per litter.

(3)                     Exotic or Wild Animal Collection Permit fee is $35.

(4)                     Multiple Companion Animal Site fee is $25 per site.

(5)                     Guard Dog Site fee is $150 per site.

(6)                     Animal Service Provider fee is $25 per year.

(7)                     Pet Store Permit fee is $50 per year.

(8)                     Animal Drawn Vehicle fee is $150 per Animal.

(9)                     Trolley Permit fee is $25 per Animal.”

Section 3.                     SEVERABILITY CLAUSE.  If any section, paragraph, sentence, clause, word or phrase of this ordinance is for any reason held to be invalid or unenforceable by any court of competent jurisdiction, such decision shall not affect the validity of the remaining provisions of this ordinance.  The Council hereby declares that it would have passed this ordinance and each section, paragraph, sentence, clause, word or phrase thereof irrespective of any provision being declared unconstitutional or otherwise invalid.

Section 4.                     COMPILATION.  Section 1 and 2 of this ordinance shall be incorporated in and made part of the Revised Ordinances of Albuquerque, New Mexico, 1994.

Section 5.                     EFFECTIVE DATE.  This ordinance shall take effect five days after publication by title and general summary.
