APPROVING THE APPOINTMENT OF A DIRECTOR TO FILL A VACANCY ON THE GOVERNING BODY OF MESA DEL SOL PUBLIC IMPROVEMENT DISTRICT 1 AND TO FILL A VACANCY ON THE GOVERNING BODY OF MESA DEL SOL PUBLIC IMPROVEMENT DISTRICTS 2 THROUGH 5 CAUSED BY THE INABILITY OF AN ELECTED DIRECTOR TO DISCHARGE THE DUTIES OF DIRECTOR FOR THE REMAINDER OF HIS UNEXPIRED TERM; TAKING ACTION PURSUANT TO THE PUBLIC IMPROVEMENT DISTRICT ACT, NMSA 1978, SECTIONS 5-11-1 THROUGH 27, AS AMENDED, AND CITY ENACTMENT NO. O-2003-012; AND REPEALING ALL ACTIONS INCONSISTENT WITH THIS RESOLUTION.
Capitalized terms used herein shall have the meanings assigned in City Enactment No. 2008-045, adopted on March 4, 2008 (the "Formation Resolution"), except as otherwise defined in this Resolution, or unless the context clearly requires otherwise.
WHEREAS, Section 5-11-9(A) of the Act provides that: "The governing body, at its option, may authorize the appointment of a separate district board. In the case of an appointed district board, three of the appointed directors shall serve an initial term of six years. Two of the appointed directors shall serve an initial term of four years.
