ESTABLISHING LEGISLATIVE AND BUDGET PRIORITIES FOR THE CITY OF ALBUQUERQUE FOR THE 2019 NEW MEXICO STATE LEGISLATURE.

WHEREAS, the State of New Mexico and the City of Albuquerque, a municipal subdivision of the State, are charged with providing for the public health, welfare and safety; and

WHEREAS, both governmental entities often share missions and responsibilities that are most effectively provided for through cooperative initiatives.                                                                                                                                    

BE IT RESOLVED BY THE COUNCIL, THE GOVERNING BODY OF THE CITY OF ALBUQUERQUE:

Section 1. The City of Albuquerque after careful consideration of its responsibilities with the State of New Mexico, respectfully request that the New Mexico State Legislature develop or support policies that provide funding and or implementation for “Significant Regional Projects,” “Neighborhood Priority Improvement Projects” and “Service Delivery Programs” as identified in this Resolution as these needs have significant local, regional and statewide impact.

 Section 2. Significant Regional Projects:

The following initiatives have regional impact and require the joint efforts and resources of the City of Albuquerque and the State of New Mexico.  It is the desire of the City to have projects or a distinct phase of a project be fully funded so that state funds can be expended in an efficient manner to benefit the community.

(A)                                          Behavioral Health and Public Safety.

(1)                     Land Mobile Radio System: $30,000,000 for modernizing the land/mobile radio system for Central New Mexico, which is critical for police and first responders.

(2)                     24/7 Emergency Shelter(s) with Crisis Triage Support: $28,000,000 for construction of shelters with triage support to provide services seven days a week and for 24 hours a day for indigent care, mental crisis treatment and addiction treatment.

(3)                     Law Enforcement Technologies: $3,000,000 for updating the Albuquerque Police Department’s crime firearm tracing analysis capacity, acquiring automated DNA testing technology, and anti-auto theft technologies.

(4)                     Public Safety Capital Outlay Set-aside: The City asks for development and adoption of a program to set aside 1% of the capital outlay funds for public safety agencies throughout the State.

(B)                     Economic and Community Development Incentive Programs, and Community Development Major Facility Improvements Projects.

(1)                     Film Credits: The City asks that the State legislature adjust the Film Production Rebates program to increase rebate caps with an emphasis on adjusting the rebate for television series to the level in place for television pilot productions.

(2)                     Albuquerque Rail Yards: $30,000,000 for the redevelopment of the 27-acre historic Albuquerque Railyards site, including site remediation, the installation of new roofs, and utility lines and connections.

(3)                     Balloon Fiesta Park Access Improvements: $7,500,000 to improve Balloon Fiesta access, which would allow for an expansion of the number of events occurring at the venue.  Improvements include constructing slip ramp from Interstate 25 to the frontage roads and constructing a rail spur into the Balloon Fiesta Park for the purpose of providing Rail Runner Service.

(4)                     Paseo Del Norte and Unser Boulevard Roadway Improvements: $2,500,000, for design of improvements to Paseo Del Norte from Calle Nortena to Rainbow Boulevard and for Unser Boulevard from Kimmick Drive to Paradise Boulevard.

(5)                     New Childhood Development Centers: $4,000,000 to construct two new childhood development centers on the Westside to accommodate the city’s population growth trends.

Section 3.                     Neighborhood Improvements Priority Projects:

The City of Albuquerque is one community created through many neighborhoods. These neighborhoods, as does the City as a whole, require continual investment. Following is a working list of neighborhood improvement projects that are candidates for Capital Outlay funds applications in that they could benefit from the resources of the State of New Mexico and the City of Albuquerque. Efforts to fund the following listed projects are multi-year combined efforts between neighborhood groups, Albuquerque City Councilors, New Mexico State Legislators and often Bernalillo County Commissioners. 

(1)                     86th Street Improvements: Pedestrian improvements in the 86th Street right of way from Bridge Boulevard to Tower Road.

(2)                     90th Street/Eucariz Storm Drain Improvements: Design and construction of storm drain improvements in the general vicinity of 90th Streets between Bridge Boulevard and Eucariz Avenue.

(3)                     ABQ Ride Montgomery and Tramway Transit Center Improvements: Construction of a break room and installation of a sanitary sewer line.

(4)                     Alameda Little League Complex Park/Alameda Little League: Construction of a perimeter fence.

(5)                     Albuquerque Regional Sports Complex Field House:  Plan, acquire land, design and construct an indoor sports field house.

(6)                     Alvarado Park: Improvements to the irrigation system and planting replacement trees.

(7)                     Balduini Park/Lobo Little League: Plan, purchase land, design and construct a replacement facility for Balduini Park.

(8)                     Cibola Loop Community Complex: Funding from implementation of phase one which includes the Northwest Mesa Library.

(9)                     Crestview Bluff Open Space:  Land acquisition and resource planning for development of open space areas to be known as the Crestview Bluff Open Space.

(10)                     Cutler Avenue Improvements: Infill sidewalk and gutter, mid-block pedestrian refuge, and lighting improvements.

(11)                     Dale Bellamah Park/Mile High Little League: Improvements to a youth baseball complex at Dale Bellamah Park.

(12)                     Downs of New Mexico Track Lights: Night sky compliant lighting for the Downs of New Mexico Race Track.

(13)                     Eisenhower Pool Improvements: Repair and renovate the Parks and Recreation Department outdoor pool at Eisenhower Middle School.

(14)                     Ellena Gallegos Open Space: Repave the road and drive lanes at the entrance and parking areas.

(15)                     Embudo Canyon Neighborhood/Tramway Road Multi-Use Trail Landscaping: Design of a landscape planting strip and bicycle trail improvements at the intersection of Tramway Road (State Road 556) and Indian School Road.

(16)                     Far Northwest Mesa Commercial Nodes Infrastructure: Funding for infrastructure to optimize roadway and pedestrian connections in Commercial Nodes in the Northwest Mesa of Albuquerque, north of Paseo Del Norte.

(17)                     Fire Station 12: Purchase land, design and construct a replacement facility for Albuquerque Fire Station 12.

(18)                     Foot Hills Area Command Police Substation Improvements: Building Improvements and repairs.

(19)                     Fourth Street Improvements: Design and construction of Complete Streets improvements to 4th Street from Coal Avenue to Avenida Cesar Chavez.

(20)                     Gibson Boulevard: Plan design and construct the extension of Gibson Boulevard from Louisiana Boulevard in Albuquerque.

(21)                     International District Library: Funding to construct and equip a library in the International District.

(22)                     Irving Boulevard Median Landscaping Improvements: Landscaping improvements on Irving Boulevard from Golf Course Road to Los Pinos Drive.

(23)                     Jeanne Bellamah Community Center: Conversion of a patio to an indoor hall and playground improvements.

(24)                     Joan Jones Community Center:  Construct phase II of the Joan Jones Community Center.

(25)                     Juan Tabo Hills Park: Construction of phase II of Juan Tabo Hills Park.

(26)                     Juan Tabo Library Landscaping Improvements: Convert turf landscaping to xeriscape.

(27)                     Ladera Golf Course Improvements: Irrigation and turf improvements to the driving range.

(28)                     LED Field Lights at Hahn Park Baseball Fields/Road Runner Little League:  Installation of LED Field lights.

(29)                     Loma Linda Community Center: Plan, design and construct a gymnasium addition to the Loma Linda Community Center.

(30)                     McMahon Boulevard Improvements: Design, construction and purchase of right of way for improvements to McMahon Boulevard from Unser Boulevard to Universe Boulevard.

(31)                     Manzano Mesa Park/Zia Little League Improvements: Improvements to a youth baseball complex.

(32)                     Manzano Mesa Park/Pickle Ball Court Lighting: Lighting for the courts at the regional pickle ball complex.

(33)                     Memorial Park: Funding for monuments at front and back of park.

(34)                     North Domingo Baca Multi-Generational Area: Construction of a gymnasium.

(35)                     Montgomery Park: improvements to the irrigation system and planting replacement trees.

(36)                     Montano Road Landscape Medians:  Medians landscape improvements on Montano Road from Kiva Street to Pojoaque Drive.

(37)                     North Domingo Baca Park: Construct a Bocce Ball Court.

(38)                     Nuevo Atrisco Village: Funding for affordable housing at the Albuquerque Metropolitan Redevelopment Agency project at the Northwest Corner of Central and Unser.

(39)                     Osuna Road Improvements Chappell Road to Edith: Development of the full roadway cross-section including completing a drainage study, acquiring land in the unincorporated county, drainage upgrades and roadway construction.

(40)                      Paseo Del Norte Improvements, Coors Boulevard to Eagle Ranch Road: Design, purchase right of way and construct improvements to Paseo Del Norte from Coors Boulevard to Eagle Ranch Road.

(41)                     Piedras Marcadas Park Patheways Plan: Design and implement a pathways plan.

(42)                     Pueblo Alto, Storm Sewer Project: Install storm lines in a zone bounded by Constitution Avenue, Lomas Boulevard, Morningside Drive and San Mateo Boulevard.

(43)                     Quintessence Park: Repairs to the playground area.

(44)                     Route 66 Visitor Center: Construction of a Route 66 Visitors Center.

(45)                     Rio Grande Boulevard Complete Streets:  Design and construction of Complete Streets improvements to Rio Grande Boulevard from Interstate 40 to Alhambra Avenue.

(46)                     San Pedro Road Improvements from Holly Avenue to North of Carmel Avenue:  Development of an existing partial cross-section to a full cross-section on San Pedro Road from Holly Avenue to 300 feet north of Carmel Avenue.

(47)                     Santa Fe Village Neighborhood Storm Drain: Design and construction of a stormwater conveyance system in the Santa Fe Village Neighborhood.

(48)                     Sandia Vista Park Dog Park: Plan, design, and construct a dog park at Sandia Vista Park.

(49)                     Southeast Community Policing Complex Facility: Construction of a Law Enforcement Substation and Bicycle Safety Education Center in the Southeast Heights.

(50)                     Taylor Ranch Road Landscape Medians: Median improvements on Taylor Ranch Road from Butterfield Trail to Calle Nortena.

(51)                     Tijeras Bio Zone Open Space: Purchase open space land in the Tijeras Arroyo to implement the Tijeras Bio Zone.

(52)                     Tramway Road and Indian School Planting Strip Area Improvements: Remediation and improvements to the planting strip and bicycle trail on Tramway Road (State Road 556) northeast of the intersection with Indian School Road, to include landscape improvements and invasive species barriers.

(53)                     Villela Park Bicycle Safety Education Center: Construct a bicycle education center at Villela Park in the McKinley Neighborhood.

(54)                     Vista Del Norte Park: Phase 3 construction of turf field.

(55)                     West Central Metropolitan Redevelopment Area: Metropolitan Redevelopment Projects in the West Central Metropolitan Redevelopment Area.

(56)                     West Gate Community Center: Phase 1 construction of a new facility for the West Gate Community Center.

(57)                     Wyoming Boulevard Improvements, Alameda Boulevard to Beverley Hills Avenue: Development of an existing partial cross-section to a full cross-section on Wyoming Boulevard from Alameda Boulevard to Beverly Hills Avenue.

Section 4.  State Programs Services and Initiatives of Significance to the City of Albuquerque.

The following state programs and initiatives are critical to the welfare of the people of Albuquerque. Many of these services and initiatives are either provided through the City of Albuquerque, are offered in conjunction with similar City services or support the provision of companion programs offered by both the City and the State.  Therefore the City of Albuquerque supports:

(A)                     Revenue Measures. 

(1)                     Maintaining local government taxing authority and gross receipts tax base.

(2)                                          Examining alternatives to improve municipal revenue streams or create diverse funding sources to stabilize municipal revenue sources.

(3)                       Identifying means and methods to improve or create an alternative to the hold harmless provision of the state budget.

(B)                     Economic Development.  

(1)                     Legislation to make Property Assessment Clean Energy Bond (PACE) financing a viable option in the State of New Mexico. This legislation if adopted would provide to local agencies that establish PACE Programs the authority to grant private pre-approved lenders who issue PACE loans the ability to use a County’s lien authority as a guarantee for the loan. This would create a lien with the status of a tax lien that would hold priority for collections in the matter of a foreclosure on the property.

(2)                     Financial Incentives for property and business owners in designated hot air balloon landing zones to dedicate their property as balloon landing areas and invest in improvements to allow for safe landings.

(3)                     The State Mainstreet Program including the Barelas, Downtown, West Central and Nob Hill Mainstreet efforts in Albuquerque.

(4)                     Adopt legislation to create a program that funds the purchase of properties in designated Metropolitan Redevelopment Areas to remove blighted structures and to stimulate redevelopment.

(5)                     Preserving and prioritizing local economic development in State economic planning.

(6)                     Increasing marketing funds for State tourism.

(7)                     Increasing marketing funds for economic development and recruitment.

(8)                     Protecting the LEDA funding level so as to maintain the fund as an evergreen fund.

(9)                     Funding the New Mexico Job Training Incentive Program.

(10)                     Adopting Enhanced Enterprise Zone Legislation that is geographically focused and has a no cost tool for collecting and distributing property tax abatement on future land value increases.

(11)                     Holding harmless the portion of property taxes allotted to Tax Increments Finance Districts, and Tax Increments Districts, so as to continue to stimulate re-development and new construction.

(12)                                          Amending the High Wage Jobs Tax Credit to remove Industry and Job Type Exclusions such as Corporate and Regional Headquarters.

(13)                       Funding the New Mexico Partnership and the Economic Development Department.

(14)                       Programs that strengthen solo workers and entrepreneurs as local economic development assets.

(15)                       Efforts that increase the investment and deployment of broadband services.

(16)                                          Grants to incubators for early-stage business creation, for International Trade Exports.

(17)                        Raise film credit cap and clear existing backlog.

(18)                        Supporting efforts to expand affordable renewable energy options for consumers and development projects and responsibly transition to a coal-free energy future.

(C)                      Education.

(1)                     Authorizing the Albuquerque Public School District to adopt rules and procedures to enable the District to form a strong partnership with the City of Albuquerque to address issues of infrastructure, over-crowding and school transportation choice, especially for schools located in rapidly growing areas with a large population of working families.

(2)                     Adequate and equitable funding for Albuquerque public schools, charter schools, institutions of higher education, and alternative schools for at-risk children.

(3)                     Full funding at all existing sites for the 21st Century Learning Center Educational Programs.

(4)                     Adequate funding early and after school programs.

(D)                       Land Use. 

(1)                     Reinstating the City of Albuquerque’s extraterritorial planning and zoning authority and authorizing the City and Bernalillo County to develop a mutually acceptable and cooperative decision-making process regarding land in the extraterritorial area.

(E)                     Animal Issues.   

(1)                     Funding to assist local animal shelters with the costs of sheltering animals under court-ordered protective custody.

(2)                     Legislation prohibiting contests organized, arranged, or sponsored for the purpose of killing coyotes for prize or exhibition.

(3)                     Addressing issues arising from the links between domestic violence, child abuse and animal abuse.

(4)                     Amending the State Cruelty Law to define neglect as cruelty and increase penalties for animal cruelty.

(F)                     General.                     

The City of Albuquerque supports the policy statements and resolutions of the New Mexico Municipal League (NMML); if any NMML policies are inconsistent with the provisions of this Resolution, the provisions herein shall prevail.
