ESTABLISHING A LEGISLATIVE POLICY FOR THE CITY OF ALBUQUERQUE FOR THE 2017 NEW MEXICO STATE LEGISLATURE.

BE IT RESOLVED BY THE COUNCIL, THE GOVERNING BODY OF THE CITY OF ALBUQUERQUE:

Section 1. The following initiatives providing for the health, safety and welfare of the people of Albuquerque require the joint efforts and resources of the State of New Mexico and the City of Albuquerque and therefore are adopted as the State legislative priorities of the City of Albuquerque:

                     (A)                     REVENUE MEASURES.   The City of Albuquerque supports:

                     (1)                     maintaining local government taxing authority and gross receipts tax base;

                     (2)                     examining alternatives to improve municipal revenue streams or create diversity to stabilize municipal revenue sources;

                     (3)                     creating a joint state and local government task force to identify means and methods to improve or create an alternative to the hold harmless provision of the state budget;

                     (4)                     creating a joint state and local government task force to identify means and methods to reorganize the capital outlay process to address the goals of the administration and the legislature while maintaining the ability to assist local agencies in funding projects.

                     (B)                     CAPITAL PROJECTS.  The City of Albuquerque requests that the legislature reauthorize existing capital outlay grants designated for City capital projects and identifies the following inventory of ongoing projects as those capital projects that could benefit from Capital Outlay requests;

(1)                      developing a Regional Crisis Stabilization Center for Bernalillo County and surrounding areas in Albuquerque;

(2)                     purchasing lands identified as priority acquisitions for the City of Albuquerque open space program including, the East Tijeras Arroyo, in Southeast Albuquerque, the La Cuentista parcels, the Middle Branch of the Boca Negra Arroyo, and the Northern One Third of the North Geological Window, all in Northwest Albuquerque and the North Rio Puerco Escarpment in west central Bernalillo County;

(3)                     design, construction and renovation of facilities at the Innovate ABQ, site;

(4)                     streetscaping improvements to Central Avenue from 98th Street to Tramway Boulevard in Albuquerque;

(5)                     constructing a gymnasium at the Pat Hurley Community Center in Northwest Albuquerque;

(6)    constructing phase II of the Regional Sportsplex in Northwest Albuquerque;

(7)                     replacing the Broadway Storm Water Pump Station in Northcentral Albuquerque;

(8)                       designing and constructing multi-use trail improvements along the Alameda Drain within the City of Albuquerque;

(9)                      design, construct and implement capital improvement recommendations adopted through the North Fourth Street Corridor Plan in Northwest Albuquerque;

(10)                      constructing pedestrian improvements to the Central Avenue railroad underpass and station platform at the NMRX railroad tracks in the Albuquerque Central Business District;

(11)                      design, construct and stabilize historic buildings at the Albuquerque Rail Yards in Southwest Albuquerque;

 (12)    constructing a Park and purchasing furnishings and information technology equipment for the Westgate Community Center in the Route 66 West Neighborhood in Southwest Albuquerque;

(13)                     constructing a Route 66 Visitor Center in Southwest Albuquerque;

(14)                     Metropolitan Redevelopment projects in the West Central Redevelopment Area near Central Avenue from the Rio Grande to Volcano Road Northwest in West Central Albuquerque;                     

(15)                     pedestrian improvements in the 86th Street right of way from Bridge Boulevard to Tower Road in Southwest Albuquerque;

(16)                     designing a Gymnasium at the North Domingo Park in Far Northeast Albuquerque;

(17)                     developing Paseo del Volcan in West Bernalillo County;

(18)                     constructing West Side Boulevard between Golf Course Road and New Mexico Highway 528 in Northwest Albuquerque;

(19)                     designing and constructing a community complex that will include a multi-generational center/library and Aquatics Center in Northwest Albuquerque;

(20)                        constructing a new full service library in the International District in Southeast Albuquerque;

(21)                         design, construct and equip a new Southeast Heights Police

Substation;

(22)                      bicycle, motor vehicle and pedestrian safety improvements in Uptown in Northeast Albuquerque;

(23)                     constructing a BMX Bicycle Park at Los Altos Park in Northeast Albuquerque;

(24)                     design and construct a new Albuquerque Fire Department  Fire Station 9 near the intersection of Eubank and Menaul in Northeast

Albuquerque;

(25)                     land acquisition, and design and construction of a facility for the public to repair bicycles and receive training to repair bicycles in the McKinley or Montgomery Park Area in Northeast Albuquerque;

(26)                     constructing phase three and security fence improvements to the Lobo Little League Complex at Balduini Park in Northeast Albuquerque;

(27)                     landscaping medians on Juan Tabo Boulevard from Candelaria Road to Menaul Boulevard in Northeast Albuquerque;

(28)                     constructing an alternative response paramedic station near the Juan Tabo Hills Subdivision in Southeast Albuquerque;

(29)                     funding for Metropolitan Redevelopment Projects in the East Gateway Corridor in Southeast Albuquerque;

(30)                     constructing Juan Tabo Hills Park; 

(31)                       constructing a gymnasium at the Loma Linda Community

   Center in Southeast Albuquerque; and

(32)                        renovation of the grounds and buildings at Ladera Golf

Course in Northwest Albuquerque.

 (D)                     ECONOMIC DEVELOPMENT.   The City of Albuquerque supports:

(1)                     the State Mainstreet program including the Barelas, Downtown, and Nob Hill Mainstreet efforts in Albuquerque;

(2)                     funding to purchase properties in targeted areas to remove blighted structures and to stimulate redevelopment;

(3)                     preserving and prioritizing local economic development in State economic planning;

(4)                     continuing incentives for the film industry;                     

(5)                     comprehensive legislation to eliminate abusive predatory lending practices, including payday, car title and predatory mortgage loans;

(6)                      increasing marketing funds for State tourism;

(7)                     increasing marketing funds for economic development and recruitment;

(8)                     efforts to make Property Assessment Clean Energy Bond (PACE) financing a viable option in the state of New Mexico;

(9)                     protecting the $50 million dollar LEDA funding level so as to maintain the fund as an evergreen fund;

(10)                     funding the New Mexico Job Training Incentive Program to $12 million and provide the necessary emergency funds to the program to fulfill the FY17 commitments;

(11)                     adopting Enhanced Enterprise Zone Legislation that is geographically focused and has a no cost tool for collecting and distributing property tax abatement on future land value increases;

(12)                     holding harmless the portion of property taxes allotted to Tax Increments Finance Districts, and Tax Increments Districts, so as to continue to stimulate re-development and new construction;

(13)                     amending the High Wage Jobs Tax Credit to remove Industry & Job Type Exclusions such as Corporate and Regional Headquarters;

(14)                     funding to the NM Partnership and the Economic Development Department;

(15)                     programs that strengthen solo workers and entrepreneurs as local economic development assets;

(16)                     efforts that increase the investment and deployment of broadband services;

(17)                     economic development tax credits without further depleting access to the credits or changing the value of the credits; and

(18)                     grants to incubators for early-stage business creation, for International Trade  Exports.

                     (E)                     CHILDREN, YOUTH AND SENIORS.  The City of Albuquerque supports:

(1)                      full funding at all existing sites for the 21st Century Learning Center Educational Programs;

(2)                     protecting Medicaid and State Children’s Health Insurance Program (SCHIP) coverage; and  

                     (3)                     protecting funding for programs for low income seniors that provide home repairs and retrofits, and assist with household chores.

 (F)                     HOUSING AND EDUCATION.  The City of Albuquerque supports:

(1)                     protecting funding for the New Mexico Housing Trust Fund;

                     (2)                     adequate and equitable funding for Albuquerque public schools, charter schools, institutions of higher education, and alternative schools for at-risk children;

                     (3)                     providing capital funding to charter schools; and

                     (4)                     requiring local school districts to enter into partnerships with local governments to achieve the most effective use of all public facilities by the community.

 (G)                     PUBLIC SAFETY.  The City of Albuquerque supports:

(1)                     adopting a resolution directing the state Department of Public Safety Crime Lab to assist the City of Albuquerque in reducing the number Albuquerque Police Department’s unprocessed sexual assault evidence kits and providing funding for both agencies to address this backlog;

(2)                     adopting a uniform act establishing a reoccurring funding source to provide for the processing and archiving of sexual assault evidence kits and related court expenses at the State Department of Public Safety Crime Lab and qualified local agency crime laboratories;

(3)                     granting local governments powers to establish and enforce curfews for persons under the age of 18 for the purposes of public safety;

(4)                      continuing funding for alcohol and drug treatment services;

(5)                       authorizing local governments to seize vehicles for the purpose of reducing the rate of repeat DUI Offenses;

(6)                     expanding the list of violent crimes that qualify for a life sentence under the current three strikes law;

(7)                     eliminating the statute of limitations for violent felonies;

(8)                     strengthening penalties and expanding the scope of identity theft laws;

(9)                     compensating local jails for the cost of holding parole violators and other State prisoners;

(10)                     prohibiting the imposition of a fee on municipalities for municipal prisoners housed in county detention facilities;

                                          (11)                     sentencing alternatives to allow more effective local control of jail populations;

                                          (12)                     strengthening the sentences for human trafficking convictions from a third-degree felony to a first-degree felony; and

                                          (13)                     amending the Treatment Guardian Act statutes to create a process for individuals to voluntarily receive treatment and supervision who are living with mental illness and are declared incompetent after being adjudicated.

                       (H)                     LAND USE.  The City of Albuquerque supports:

(1)                     reinstating the City of Albuquerque’s extraterritorial planning and zoning authority and authorizing the City and Bernalillo County to develop a mutually acceptable and cooperative decision-making process regarding land in the extraterritorial area.

 (I)                     ANIMAL ISSUES.  The City of Albuquerque supports: 

                     (1)                       funding to assist local animal shelters with the costs of sheltering animals under court-ordered protective custody;

                     (2)                     addressing issues arising from the links between domestic violence, child abuse and animal abuse; and

                     (3)                     amending the State Cruelty Law to define neglect as cruelty and increase penalties for animal cruelty.

 (J)                     GENERAL.                     The City of Albuquerque supports the policy statements and resolutions of the New Mexico Municipal League (NMML); if any NMML policies are inconsistent with the provisions of this Resolution, the provisions herein shall prevail.
