Requiring The City Of Albuquerque To Immediately Cease Construction In The Rio Grande Bosque Between Central Avenue And Interstate 40; Amending The Adopted Capital Implementation Program Of The City Of Albuquerque By Approving New Projects And Changing The Scope Of Existing Projects (Benton, Sanchez)

WHEREAS, the Administration of the City of Albuquerque committed to publish a final environmental report and work with stake holders of the Rio Grande Valley State Park to develop an implementation report for constructing improvements in the Rio Grande Bosque State Park; and
WHEREAS,  Subsequent to and in violation of that commitment, the Administration has commenced with constructing improvements in the Rio Grande Valley State Park; and
WHEREAS, F/S R-08-182 created the Bosque Restoration & Revitalization project and provided an appropriation from the 2009 General Obligation Bond program of $200,000, of which $181,498 has been expended or encumbered; and
WHEREAS, F/S R-11-183 created the Bosque Restoration & Revitalization project and provided an appropriation from the 2011 General Obligation Bond program of $200,000, of which $177,779 has been expended or encumbered; and
WHEREAS, F/S R-13-125 created the River Amenities, Enhancements, Bosque Restoration and Trail Development project and provided an appropriation from the General Fund of $2,892,000, of which $523,821 has been expended or encumbered.
BE IT RESOLVED BY THE COUNCIL, THE GOVERNING BODY OF THE CITY OF ALBUQUERQUE:
      Section 1. That the Administration of the City of Albuquerque immediately cease construction of a gravel trail in the Rio Grande Bosque between Central Avenue and Interstate-40 until such time as the previous public commitment to publishing a final environmental monitoring report with a summary of public comment and responses.
      Section 2. That the Administration complete the public process allowing public review and comment on specific design options before selection of the final plan.
Section 3. That the Administration comply with all federal and state environmental and cultural resource laws.
Section 4. That the Administration submit final implementation report to the Middle Rio Grande Conservancy District for review and approval in accordance with the Joint Powers Agreement.
Section 5.  That the Administration restore damaged areas that are not included in the final implementation report.
Section 6. That the following project descriptions are amended as indicated:
Parks and Recreation - Fund 305
Bosque Restoration & Revitalization      2009 GO Bonds
      The scope of the project is amended to read as follows:
"Restore and revitalize the river and Bosque.  Remove non-native trees, trash, debris & Jetty Jacks.  Plant native trees and shrubs to create healthy Bosque habitats. Plan, design and construct restrooms, and install interpretative & regulatory information signs & kiosks."
Bosque Restoration & Revitalization      2011 GO Bonds
      The scope of the project is amended to read as follows:
"Restore and revitalize the river and Bosque.  Remove non-native trees trash debris & Jetty Jacks.  Plan, design, improve, equip and construct restrooms."
      Section 7.  That the following appropriations are hereby made and/or changed:
