RESOLUTION
AMENDING F/S R-08-47 WITH RESPECT TO THE COMPOSITION AND FUNCTION OF THE RAIL YARDS ADVISORY BOARD.
    WHEREAS, F/S R-08-47 established a pre-development process for the City-owned Rail Yards property in the Barelas neighborhood, including specifying certain pre-development activities, expressing the Council's support for the designation of the Rail Yards site and its structures as City landmarks, requiring Council approval for any use of the site exceeding 180 days, and creating the Rail Yards Advisory Board (the Board) to establish a competitive process for selecting a Master Developer and oversee the redevelopment process; and
    WHEREAS, since the adoption of F/S R-08-47, the City has made significant progress with certain pre-development activities, including undertaking detailed environmental remediation analyses (completion of Phase I and Phase II reports with the New Mexico Environment Department and the Environmental Protection Agency), selecting a Master Developer, and commencing the development of a Master Plan for the site; and
WHEREAS, the Board, which is made up of elected representatives of the community in order to ensure transparency, extensive community consultation, and collaboration in the decision-making process, has diligently and actively participated in assisting the City in its efforts to redevelop the Rail Yards site; and
WHEREAS, due to changes in representation that have resulted from City and State redistricting and varying levels of availability and interest of appointed members, it is necessary to update the membership of the Board; and
WHEREAS, the Board has provided valuable insight and direction regarding various aspects of the redevelopment process and served as a venue for transparently vetting proposals and agreements related to the project; and
WHEREAS, the City desires for the Board to continue to oversee the redevelopment process and provide for an orderly, transparent process for coordinating, reviewing and advising the City on matters related to the redevelopment of the site.
BE IT RESOLVED BY THE COUNCIL, THE GOVERNING BODY OF THE CITY OF ALBUQUERQUE:
SECTION 1.  Section 3 of F/S R-08-47 is hereby amended as follows: "The City shall form the Rail Yards Advisory Board to establish a competitive process for the selection of a Master Developer.  The Master Developer shall assist the City of Albuquerque and the Advisory Board in developing a Master Plan for the site.  The Master Plan shall be reviewed by the Rail Yards Advisory Board and the Environmental Planning Commission prior to being considered for approval by the City Council. A summary of the Master Development and Disposition Agreement shall be presented to the Rail Yards Advisory Board for review prior to being considered for approval by the City Council. The Rail Yards Advisory Board shall complete its review within 20 days of receipt of the summary.
The Advisory Board shall consist of the following members and shall continue to oversee the redevelopment of the Rail Yards, including advising the City regarding the approval and implementation of a Master Plan, the establishment of interim and/or long-term uses, and the programming and expenditure of capital and operating funds to support redevelopment efforts:
A.  City of Albuquerque
            i.      The Mayor or Mayor's designee
            ii.      The City Councilor elected to represent the Rail Yards
area or his/her designee
      B.  State of New Mexico
i.      A representative appointed by the Governor
ii.      The State Senator elected to represent District 12
iii.      The State Senator elected to represent District 14
iv.      The State Representative elected to represent District 11
v.      The State Representative elected to represent District 14      
C.  Bernalillo County: The County Commissioner elected to represent the Rail Yards area or his/her designee
D. A representative elected by the Barelas neighborhood
E. A representative elected by the South Broadway neighborhood
F. A representative of the WHEELS Museum
