Adopting A Proposition To Be Submitted To The Voters At The Next Municipal Election Concerning Continuation Of The Safe Traffic Operations ["Red Light"] Program (Lewis)

ADOPTING A PROPOSITION TO BE SUBMITTED TO THE VOTERS AT THE NEXT MUNICIPAL ELECTION CONCERNING CONTINUATION OF THE SAFE TRAFFIC OPERATIONS [“RED LIGHT”] PROGRAM .
WHEREAS, on April 4, 2005 the City Council approved the creation of the Safe Traffic Operations Program (“STOP”); and
WHEREAS, STOP allows the use of photo red light cameras and electronic speed detection equipment to determine if a speeding or red light violation had occurred and to document such violation with photographic or electronic evidence; and
WHEREAS, STOP violations are declared to be a nuisance, enforceable through a civil process; and
WHEREAS, the ordinance creating STOP has been amended on at least seven separate occasions, including the need to amend the ordinance to deal with legislation adopted by the State of New Mexico imposing limits on STOP and similar programs; and
WHEREAS, the value of STOP as a deterrent to dangerous driving behavior and as a benefit to the safety of residents of Albuquerque is disputed; and
WHEREAS, the City Council finds that the voters of the City of Albuquerque should consider the benefits and detriments of STOP and determine if it is in the best interest of the residents of the City to continue the program.
BE IT RESOLVED BY THE COUNCIL, THE GOVERNING BODY OF THE CITY OF ALBUQUERQUE:
Section 1. That the City Clerk is instructed to place the following proposal on the next municipal election ballot, and the qualified voters of the City of Albuquerque shall be permitted to vote “for” or “against” the following proposal:
