Qualifying Procedures For Traffic Calming Devices On Local Streets Adjacent To Schools And Parks.

                     WHEREAS; the City installs traffic calming devices on municipal streets for the purpose of guiding motorists to proceed safely on a roadway. Traffic calming devices reduce the speed of those motorists exceeding the speed limit, notify a distracted motorist that additional caution is required and reconfigure a street so as to prohibit cruising. These devices also provide refuges or platforms where pedestrians can stand to increase their view of oncoming vehicles and the motorist's view of the pedestrian; and

                     WHEREAS; The City has installed traffic calming devices including bulb outs, speed humps and road closures around schools and parks to better manage the interaction between motorists and pedestrians. These locations present safety challenges due to the frequent interaction between pedestrians and motorists. These challenges include a combination of traffic congestion, pedestrians crossing streets at different locations, motorists egressing and ingressing from parked cars and balls from a game rolling into the street.

BE IT RESOLVED BY THE COUNCIL, THE GOVERNING BODY OF THE CITY OF ALBUQUERQUE:

SECTION 1.  In addition to the Traffic Engineer's Authority as provided under §8-1-2-4 of the City Code of Ordinances to install traffic control devices, including traffic calming devices the following procedures also apply for installing traffic calming devices on City of Albuquerque Right of Ways that are adjacent to city parks or schools:

1.                     Parks:

a.                     A person or persons who resides or owns a business or property adjacent to a section of a local street that borders a City park may file a request to install traffic calming devices on street segments adjacent to the park.  The written request shall document the pedestrian and traffic hazards adjacent to the park.

b.                     The City Traffic Engineer, upon receiving the request and as the availability of resources allows, shall determine the boundary of the area where the traffic calming devices will be installed and develop a traffic calming plan for that area. 

c.                     A person or persons who reside or work within the plan area will distribute copies of the plan to those residents, business and property owners adjoining the street sections in the plan area and request approval of the plan by either letter or petition from persons representing 67% of the lots within the plan area.  The City shall provide the list of lots from which approval is required. Signatures must be obtained within a 12 month period.

d.                     The City traffic engineer upon receiving the approvals will implement the traffic calming plan when the necessary personnel, materials and funding become available.

2.                     Schools:

a.                     A person or persons who resides or owns a business or property adjacent to a section of a local street that borders a school accredited by the New Mexico Department of Education, or the principal or director of such institution, may file a request to install traffic calming devices on the street segments adjacent to the school.  The written request shall document the pedestrian and traffic hazards adjacent to the school.

b.                     The City Traffic Engineer, upon receiving the request and as the availability of resources allows, shall determine the boundary of the area where the traffic calming devices will be installed and develop a traffic calming plan for that area.

c.                     A person or persons who resides or works within the plan area, shall distribute copies of the plan to the residents, business owners and property owners within the plan area and request approval of the plan by either letter or petition from persons representing 67% of the lots within the plan area.  The City shall provide the list of lots from which approval is required. Signatures must be obtained within a 12 month period.
