Amending Chapter 8, Article 2, Part 2 ROA 1994, A Portion Of The Traffic Code, To Insert A New Subpart To Prohibit Cruising During Certain Hours In Areas Designated As "No Cruise Zones"; Defining "Cruising"; Creating Exceptions; Providing A Penalty.

BE IT ORDAINED BY THE COUNCIL, THE GOVERNING BODY OF THE CITY OF ALBUQUERQUE:
Section 1.Findings. The Council finds that the repetitive driving through an area, or "cruising," threatens the public health, safety, and welfare. The Council further finds that the heightened traffic congestion caused by cruising and associated secondary activities resulting from cruising result in a need for an increased demand for police service in the areas of the City where cruising occurs. The Council finds that the following illegal activities are associated with cruising: driving while intoxicated, public drunkenness, alcohol consumption by minors, speeding, reckless driving, assault, disorderly conduct, trespassing, vandalism, and excessive noise from vehicles and amplifiers. The Council further finds that cruising has resulted in an increased number of vehicular accidents in certain areas of the City.
Section 2.Chapter 8, Article 2, Part 2 ROA 1994 is amended by inserting the following new subpart to read:
[+ (A)No person shall cruise, or permit a motor vehicle under that person's care, custody or control, to cruise in an area that has been posted as "no cruise zone" or "no cruising".
(B)For the purpose of this subpart, the following definitions shall apply:
(1)CRUISE. To operate or occupy any motor vehicle which has been driven past a traffic control point on a public way three or more times in either direction within a two-hour period between 8:00 p.m. and 4:00 a.m. in a no cruise zone.
