REPEALING CHAPTER 14, ARTICLE 5, PART 1 AND PART 2 (THE FLOOD HAZARD AND DRAINAGE ORDINANCES), ADOPTING A NEW "FLOOD DAMAGE PREVENTION ORDINANCE" IN ITS PLACE, AND AMENDING THE TITLE OF CHAPTER 14.
BE IT ORDAINED BY THE COUNCIL, THE GOVERNING BODY OF THE CITY OF ALBUQUERQUE:
SECTION 1. The Flood Hazard and Draining Ordinances, Chapter 14, Article 5, Part 1 and Part 2 of the Revised Ordinances of Albuquerque, are hereby repealed in their entirety.
SECTION 2. A new "Flood Damage Prevention Ordinance" is hereby adopted as Chapter 14, Article 5 of the Revised Ordinances of Albuquerque, as follows:
ARTICLE 5: FLOOD DAMAGE PREVENTION ORDINANCE
PART 1: STATUTORY AUTHORIZATION, FINDINGS OF FACT, PURPOSE, AND METHODS

The Legislature of the State of New Mexico has in NMSA 1978, Section 3-18-7 delegated the responsibility of local governmental units to adopt regulations designed to minimize flood losses. Therefore, the Council of the City of Albuquerque, New Mexico does ordain as follows:
? 14-5-1-2 FINDINGS OF FACT
(1) The flood hazard areas of the City of Albuquerque are subject to periodic inundation, which results in loss of life and property, health and safety hazards, disruption of commerce and governmental services, and extraordinary public expenditures for flood protection and relief, all of which adversely affect the public health, safety and general welfare.
