WHEREAS, a rental bill of rights is essential to protect the rights of tenants and ensure fair housing practices; and
WHEREAS, tenants have a fundamental right to a safe, habitable, and affordable living environment; and
WHEREAS, renters can be a vulnerable population as compared to homeowners; and
WHEREAS, approximately 44% of Albuquerque households are renters; and
WHEREAS, of that 44%, 58% are households with persons of color and 18% of renter households report living below the poverty line; and
WHEREAS, 50% of renter households report spending more than 30% of their income on rent, classifying them as rent-burdened; and
WHEREAS, landlords have a responsibility to provide adequate housing and maintain properties in a condition that complies with applicable laws and regulations; and
WHEREAS, a clear and comprehensive rental bill of rights can help to prevent disputes and misunderstandings between tenants and landlords; and
WHEREAS, the absence of a comprehensive rental bill of rights may lead to varied and sometimes unjust treatment of tenants, making it essential to establish a unified framework to ensure fair and equitable rental practices for renters in Albuquerque.
BE IT ORDAINED BY THE COUNCIL, THE GOVERNING BODY OF THE CITY OF ALBUQUERQUE:
SECTION 1. A new Article 28 in Chapter 14 of the Revised Ordinances of Albuquerque is hereby adopted as follows:
? 14-28-1 SHORT TITLE.
This ordinance shall be known and may be cited as the Renter's Empowerment and Neighborhood Transparency ("RENT") Ordinance.
