Appropriating Funds Within The Fiscal Year 2026 Operating Budget To Support Juneteenth Activities And Rescinding R-26-31 (Rogers)

APPROPRIATING FUNDS WITHIN THE FISCAL YEAR 2026 OPERATING BUDGET TO SUPPORT JUNETEENTH ACTIVITIES AND RESCINDING R-26-31.

WHEREAS, the City of Albuquerque adopted the Fiscal Year 2026 Operating Budget, which includes non-recurring appropriations within the Arts and Culture Department; and

WHEREAS, the FY/26 budget includes a $25,000 non-recurring appropriation for “African American Performing Arts”; and

WHEREAS, the Arts and Culture Department has indicated that no agreement is in place with an organization to expend these funds and that the funds cannot be administratively reallocated without Council action; and

WHEREAS, the City Council desires to ensure that these funds are utilized in a timely manner to support community programming; and

WHEREAS, Juneteenth is a federally recognized holiday commemorating the emancipation of enslaved African Americans and is observed through community events, cultural programming, and educational activities; and

WHEREAS, reallocating these funds to support Juneteenth programming aligns with the intent of supporting cultural and community-based initiatives; and

WHEREAS, R-26-31 was passed by a 9-0 vote on May 18, 2026, but pursuant to ROA 1994, § 2-11-15, bills appropriating funding require two City Council hearings before final action.

BE IT RESOLVED BY THE COUNCIL, THE GOVERNING BODY OF THE CITY OF ALBUQUERQUE:

                     SECTION 1. That the following appropriations are hereby adjusted to the following programs from fund balance and/or revenue for operating City government in Fiscal Year 2026:

GENERAL FUND- 110

Arts and Culture Department

                     The Arts and Culture Department is hereby directed to use the non-recurring item titled “African American Performing Arts” in the amount of $25,000 within the Community Events Program to provide additional funding of $25,000 for the non-recurring item titled “Juneteenth,” within the Community Events Program.

SECTION 2. R-26-31 is hereby rescinded.

SECTION 3. SEVERABILITY. If any section, paragraph, sentence, clause, word or phrase of this Resolution is for any reason held to be invalid or unenforceable by any court of competent jurisdiction, such decision shall not affect the validity of the remaining provisions of this Resolution. The Council hereby declares that it would have passed this Resolution and each section, paragraph, sentence, clause, word or phrase thereof irrespective of any provision being declared unconstitutional or otherwise invalid.
