RESCINDING R-25-154, WHICH ESTABLISHED A MORATORIUM ON FIBER INTERNET INSTALLATION PERMITS AND ESTABLISHED A WORKING GROUP TO REEVALUATE PERMITTING CRITERIA AND OTHER REQUIRED STANDARDS.

WHEREAS, on May 19, 2025, the City Council passed R-25-154, which established a moratorium on the issuance of Fiber Internet Installation Permits that would become effective on September 1, 2025, unless the City Council accepted recommendations made by a working group comprised of critical stakeholders; and

WHEREAS, the purpose of the proposed moratorium was to encourage stakeholders to address the significant concerns raised by members of the community relating to the rapid deployment of fiber installation throughout the City; and

WHEREAS, numerous stakeholders convened for multiple meetings and proposed many thoughtful changes to the process for installing fiber internet, which would address many of the issues affecting the community; and

WHEREAS, after many meetings, the working group agreed to a set of recommendations to present to the City Council; and

WHEREAS, the report as introduced did not reflect the months of work by the working group; and

WHEREAS, the report would not be considered by the Council before the moratorium is set to be imposed; and

WHEREAS, it would be inappropriate for a moratorium to be imposed when stakeholders meaningfully participated in crafting a plan; and

WHEREAS, continuing to discuss the insufficient report does not ultimately help the people of Albuquerque; and

WHEREAS, it would be more valuable to the citizens of Albuquerque to craft and consider appropriate policies regarding the installation of fiber internet in Albuquerque utilizing the expertise of the working group than continuing to discuss the previous resolution; and

WHEREAS, rescinding R-25-154 will prevent a moratorium on fiber installation permits from going into effect.

BE IT RESOLVED BY THE COUNCIL, THE GOVERNING BODY OF THE CITY OF ALBUQUERQUE:

SECTION 1. R-25-154 is rescinded in its entirety.

SECTION 2. SEVERABILITY. If any section, paragraph, sentence, clause, word or phrase of this Resolution is for any reason held to be invalid or unenforceable by any court of competent jurisdiction, such decision shall not affect the validity of the remaining provisions of this Resolution. The Council hereby declares that it would have passed this Resolution and each section, paragraph, sentence, clause, word or phrase thereof irrespective of any provision being declared unconstitutional or otherwise invalid.
