THIRD UPDATE TO ATTACHMENT 1 TO R-20-47 APPROPRIATING TRANSPORTATION INFRASTRUCTURE TAX FUNDS TO EXPAND THE SCOPE OF THE CUTLER AVENUE COMPLETE STREETS PROJECT TO INCLUDE THE SAN PEDRO COMPLETE STREETS PROJECT.

WHEREAS, R-20-47 (Enactment R-2020-091) appropriated funds to implement the third phase of the Transportation Infrastructure Tax to fund  projects that improved the user-ability of the City’s street system; and

                     WHEREAS, R-20-47 provided $2,300,000 in funding for a Complete Streets project on Cutler Avenue from Carlisle Boulevard to Washington Street; and

                     WHEREAS, the Cutler project is 90% complete and upon completion there will be a remaining fund balance; and

                     WHEREAS, the City of Albuquerque is implementing a complete streets project on San Pedro Road from Cagua Place to Lomas Boulevard and additional funds are required to implement the next phase of the project; and

                     WHEREAS, expanding the Cutler Avenue Complete Streets project scope to include the San Pedro Complete Streets Project will authorize the use of the remaining balance from the Cutler Project for the San Pedro project.

BE IT RESOLVED BY THE COUNCIL, THE GOVERNING BODY OF THE CITY OF ALBUQUERQUE:

                     Section 1. Attachment 1 to R-20-47 (attached to this Resolution) is amended to expand the Cutler Avenue Project scope to include the Streetscape Improvements to San Pedro Road from Cagua Place to Lomas Boulevard.

Section 2. SEVERABILITY. If any section, paragraph, clause or provision of this Resolution is held to be invalid or unenforceable for any reason, the invalidity or unenforceability of that section, paragraph, clause or provision shall not affect any of the remaining provisions of this Resolution.
