Amending The City Code Of Ordinances Relating To The Preparation Of Reports, Plans, Technical Documents And Drawings By The City Council Services Department (Grout)

BE IT ORDAINED BY COUNCIL, THE GOVERNING BODY OF THE CITY OF ALBUQUERQUE:
SECTION 1. A new Part 42 is inserted into Chapter 5, Article 5, of the City Code of Ordinance as follows:
“[§ 5-5-42 CITY COUNCIL PREPARATION OF REPORTS, PLANS, TECHNICAL DOCUMENTS AND DRAWINGS.
The Director of City Council Services may prepare and/or issue a contract for consulting engineers, architects, and landscape architects through the Selection Advisory Committee Process in ROA 1994, Sections 14-7-2-1 et seq. The services to be included in the contract may include reports, and thirty percent (30%) plans, drawings and technical documents. The contract may include services for plans, drawings and technical documents beyond thirty percent (30%) if the contract is for a project designated through a resolution adopted by the City Council. A Department managing any phase of the design of an Architectural, Engineering, or Landscape Architecture project shall brief the sponsoring project’s Councilor, or their representative, on the status of the design process a minimum of every 30 days. The span of time between briefings may only be adjusted with consent of the sponsoring Councilor.]”
SECTION 2. The Selection Advisory Committee Ordinance (Chapter 14, Article 7, Part 2, of the Revised Ordinances of Albuquerque) is amended to insert a new Section 11 as follows:
“[§ 14-7-2-11 City Council Services Contracts.
Contracts for the City Council Services Department for consulting engineers, architects, and landscape architects selected through the Selection Advisory Committee process, shall be prepared and negotiated by the Director of City Council Services. The final contract shall be signed by the Director of City Council Services, the Chief Administrative Officer and the City Attorney.]”
SECTION 3. SEVERABILITY. If any section, paragraph, sentence, clause, word or phrase of this Ordinance is for any reason held to be invalid or unenforceable by any court of competent jurisdiction, such decision shall not affect the validity of the remaining provisions of this Ordinance. The Council hereby declares that it would have passed this Ordinance and each section, paragraph, sentence, clause, word or phrase thereof irrespective of any provision being declared unconstitutional or otherwise invalid.
SECTION 4. COMPILATION. Sections 1 and 2 of this Ordinance shall amend, be incorporated in, and be compiled as part of the Revised Ordinances of Albuquerque, New Mexico, 1994.
SECTION 5. EFFECTIVE DATE. This ordinance shall take effect five (5) days after publication by title and general summary.
