REPEALING THE ST. JOSEPH HOSPITAL METROPOLITAN REDEVELOPMENT AREA DESIGNATION AND PLAN AND AMENDING THE CODE OF RESOLUTIONS.
WHEREAS, the State of New Mexico has enacted the Metropolitan
Redevelopment Code (herein the “MR Code”), Chapter 3, Article 60A, Sections 1-49, NMSA 1978, as amended, which authorizes the City of Albuquerque, New Mexico (herein the “City”) to prepare and amend metropolitan redevelopment plans to undertake and carry out metropolitan redevelopment projects; and
WHEREAS, the City has adopted the Metropolitan Redevelopment Agency Ordinance (herein the “MRA Ordinance”) ROA 1994, Chapter 14, Article 8, Part 4, as amended, which creates the Metropolitan Redevelopment Agency (herein the “MRA”) and delegates from the Albuquerque City Council (herein the “Council”) to the MRA the exercise of certain metropolitan redevelopment project powers set forth in the Code; and
WHEREAS, City Council, the Governing Body of the City of Albuquerque,
has the authority to adopt, amend and repeal Metropolitan Redevelopment Area
designations and plans per the MR Code and the MRA Ordinance; and
WHEREAS, in July 1979, City Council designated the St. Joseph Hospital & Civic Auditorium Urban Renewal/Metropolitan Redevelopment Area and also adopted an Urban Renewal Plan/Sector Development Plan, which also functioned as a Metropolitan Redevelopment Plan (R-149-1979); and
WHEREAS, the primary objective of the Designation and Plan was to
provide a land use solution for the St. Joseph Hospital and Civic Auditorium Area that: 1) Provided for the growth and development needs of the Hospital as a major City institution; 2) Furthered the City’s neighborhood revitalization and preservation goals; 3) Retained the viability of the Civic Auditorium site for appropriate future re-use or redevelopment; and
WHEREAS, in 2017, the Governing Body adopted the Integrated Development Ordinance (IDO) and eliminated sector development plans (O-17-49) while leaving those portions of the plans that functioned as metropolitan redevelopment plans in effect (R-2017-102); and
WHEREAS, henceforth, the St. Joseph Hospital and Civic Auditorium Urban
Renewal Sector Development Plan was named the St. Joseph Hospital
Metropolitan Redevelopment Plan; and
WHEREAS, public notice regarding the repeal of the St. Joseph Hospital
Metropolitan Redevelopment Plan Area and Plan was provided to affected
property owners and Neighborhood Associations, as required by law; and
WHEREAS, an on-line stakeholder meeting for the property owners,
neighborhood associations and the public, was held on September 3, 2025; and
WHEREAS, the Albuquerque Development Commission held a public hearing on September 18, 2025 to review this item and consider public comment; and
WHEREAS, the ADC determined through this public process that the goals of the St. Joseph Hospital Metropolitan Redevelopment Area and Plan have been achieved as evidenced by the successful build out of the area with health care and related uses; and
WHEREAS, the MR designation and Plan are no longer necessary for the
economic success of the Area.
BE IT RESOLVED BY THE COUNCIL, THE GOVERNING BODY OF THE CITY OF ALBUQUERQUE:
SECTION 1. REPEAL. Resolution R-149-1979 is hereby repealed in its entirety.
SECTION 2. INCORPORATION. Resolution 149-1979 is repealed and the
Code of Resolutions of Albuquerque, New Mexico, Section 1-12-4, shall be amended to add the word “REPEALED” with the repeal date, at the end.
SECTION 3. SEVERABILITY CLAUSE. If any section, paragraph, sentence,
clause, word or phrase of this Resolution is for any reason held to be invalid or unenforceable by any court of competent jurisdiction, such decision shall not affect the validity of the remaining provisions of this Resolution. The Council hereby declares that it would have passed this Resolution and each section, paragraph, sentence, clause, word or phrase thereof irrespective of any provisions being declared unconstitutional or otherwise invalid.
SECTION 4. COMPILATION. Section 2 of this Resolution amends, is incorporated in, and is to be compiled as part of the Code of Resolutions of the City of Albuquerque, New Mexico, Section 1-12-4.
