RESCINDING ENACTMENT NO. O-2021-025 (COUNCIL BILL NO. O-21-80) WHICH REQUIRED THE USE OF PROJECT LABOR AGREEMENTS ON CERTAIN PUBLIC WORKS CONSTRUCTION PROJECTS IN THE CITY OF ALBUQUERQUE.

                     WHEREAS, On December 6, 2021 Albuquerque City Council adopted an amendment to the Public Purchasing Ordinance adopting the use of project labor agreements on certain public works construction projects that were anticipated to exceed Ten Million Dollars ($10,000,000) and where at least three crafts were to be employed on the project.

                     BE IT ORDAINED BY THE COUNCIL, THE GOVERNING BODY OF THE CITY OF ALBUQUERQUE:

                     SECTION 1.   Enactment No. O-2021-025 (Council Bill No. O-21-80) is hereby rescinded and Sections 5-5-11 (H) 1 through 5 of the Revised Ordinances of Albuquerque is relabeled as “repealed”:

REPEALED.

                     SECTION 2. SEVERABILITY CLAUSE.  If any section, paragraph, sentence, clause, word or phrase of this ordinance is for any reason held to be invalid or unenforceable by any court of competent jurisdiction, such decision shall not affect the validity of the remaining provisions of this ordinance.  The Council hereby declares that it would have passed this ordinance and each section, paragraph, sentence, clause, word or phrase thereof irrespective of any provision being declared unconstitutional or otherwise invalid.

                     SECTION 3. COMPILATION. The ordinance amendment prescribed by SECTION 1 shall amend, be incorporated in, and be made part of the Revised Ordinances of Albuquerque, New Mexico 1994.
