REQUIRING COMMUNICATION OF INTRA-YEAR ADMINISTRATIVE RATE AND FEE ADJUSTMENTS TO THE CITY COUNCIL PRIOR TO IMPLEMENTATION.
WHEREAS, the City charges fees and sets rates for a variety of General Fund and Enterprise Fund services and activities; and
WHEREAS, the Mayor can administratively increase or amend City rates and fees that are not otherwise specifically established by an City Ordinance, or that are not generally required to be set by City Ordinance; and
WHEREAS, City Budget Ordinance Section 2-11-10 (A) requires that any fee or rate adjustment for the upcoming fiscal year be submitted by the Mayor to the Council with the Mayor’s annual operating budget proposal; and
WHEREAS, the increase or adjustment of a City rate or fee may be necessary within the middle of a fiscal year to support the continuation or expansion of a valuable City service; and
WHEREAS, both the City Council and general public should be made aware of proposed administrative rate and fee increases done outside of the annual operating budget process.
BE IT RESOLVED BY THE COUNCIL, THE GOVERNING BODY OF THE CITY OF ALBUQUERQUE:
SECTION 1. DEFINITIONS.
Administrative Rate or Fee. Any general or enterprise rate or fee charged by the City that the Mayor has administrative discretion to increase or otherwise amend without action or approval by the City Council.
MID-FISCAL YEAR ADJUSTMENT. Any administrative rate or fee adjustment proposed to occur outside of the annual operating budget.
SECTION 2. COMMUNICATION TO COUNCIL OF ADMINISTRATIVE RATE OR FEE ADJUSTMENTS.
(A) The Mayor shall submit an executive communication to the City Council for its receipt of all mid-fiscal year rate or fee adjustment proposals. Such executive communications must be received by the Clerk of the Council at least 90 days before the rate or fee adjustment is proposed to become effective.
(B) The Mayor shall continue to submit administrative rate or fee adjustments that will take affect at the beginning of a given fiscal year (July 1) with that year’s proposed fiscal year operating budget, per Section 2-11-10 (A) ROA 1994.
