Requesting That The Congress Of The United States Of America Continue The Public Health Emergency Leave Provisions Of The Emergency Family And Medical Leave Expansion Act Through December 31st, 2021 (Bassan, Gibson, Borrego)

REQUESTING THAT THE CONGRESS OF THE UNITED STATES OF AMERICA CONTINUE THE PUBLIC HEALTH EMERGENCY LEAVE PROVISIONS OF THE EMERGENCY FAMILY AND MEDICAL LEAVE EXPANSION ACT THROUGH DECEMBER 31^st, 2021.

                     WHEREAS, the United States Congress adopted the Emergency Family and Medical Leave Expansion Act in March of 2020; and

                     WHEREAS, Section 2601 of the Act requires employers to provide paid sick leave to employees who become ill or are quarantined with COVID-19, or who are the primary care givers for a person ill with COVID-19.  Full time employees are entitled to 80 hours of sick leave and part time employees are entitled to the average number of hours that they work over a two-week period; and

                     WHEREAS, Section 7001 of the Emergency Family and Medical Leave Expansion Act, so as to assist employers that incur COVID-19 sick leave expenses, established a federal tax credit of $200 to $511 a day per employee for employers who provide sick leave under Section 2601 of the Act; and

                     WHEREAS, Section 2601 of the Act will expire on December 31^st, 2020, the impacts of which will place an undue burden on employers already struggling to stay in business through a recession and will reduce the likelihood employees directly impacted by COVID-19 will receive sick leave; and

WHEREAS, The Health and Economic Recovery Omnibus Emergency Solution (HEROES) Act extends the Sick Leave and Sick Leave Tax

Credit Provisions of the Family and Medical Leave Expansion Act through

December 31^st 2021.

BE IT RESOLVED BY THE COUNCIL, THE GOVERNING BODY OF THE CITY OF ALBUQUERQUE:

Section 1.  The City of Albuquerque urges the Congress of the United States to extend the COVID-19 paid sick leave and tax credit provisions, established in the Emergency Family and Medical Leave Expansion Act, through December 31^st 2021.

Section 2.  That this Resolution be presented and delivered to members of the Congressional Delegation.
