AMENDING ARTICLE XVI SECTION 3 AND SECTION 6 OF THE CITY CHARTER; CHAPTER 2 ARTICLE 4, SECTION 13, ROA 1994 TO: CHANGE THE DATES OF THE EXPLORATORY PERIOD FOR MAYORAL CANDIDATES; CHANGE THE DATES OF THE QUALIFYING PERIOD FOR MAYORAL AND COUNCIL APPLICANT CANDIDATES; CHANGE THE TIMEFRAME FOR GATHERING SEEDMONEY; AND CHANGE THE TIME FRAME FOR ALL CANDIDATES TO FILE THEIR PETITIONS.

BE IT ORDAINED BY THE COUNCIL, THE GOVERNING BODY OF THE CITY OF ALBUQUERQUE:

SECTION 1. Article XVI, Sections 3 and 6 are amended as follows:

CITY CHARTER, ART. XVI, OPEN AND ETHICAL ELECTIONS CODE

Section 3.  DEFINITIONS.

(G)                     EXPLORATORY PERIOD

(1)                      For Mayoral Applicant Candidates, the exploratory period begins 246 days before the election, and ends 200 days before the election; and

(2)                     For Council Applicant Candidates, the exploratory period begins 191 days before the election, and ends 156 days before the election.

(Q)                     QUALIFYING PERIOD.

(1)                     For Mayoral Applicant Candidates the Qualifying Period begins 199 days before the election, and ends 136 days before the election; and                                          

(2)                     For Council Applicant Candidates, the Qualifying Period begins 155 days before the election, and ends 120 days before the election.

Section 6.  SEED MONEY-IN-KIND CONTRIBUTIONS.

(H)                     Mayoral Applicant Candidates may accept Seed Money from 246 days before the election through 136 days before the election. Council Candidates may accept Seed Money from 191 days before the election through 120 days before the election.

SECTION 2. Chapter 2, Article 4, Section 13 is amended as follows:

§ 2-4-13  FILING OF PETITIONS.

(B)                     Persons submitting petitions in accordance with Section 4, Article II of the City Charter shall collect all signatures on such petitions during the following periods in the year of the election:

                     (1)                     For Mayoral candidates who are seeking public financing, starting 199 days before the election, and ending 136 days before the election;

                     (2)                     For Mayoral candidates who are seeking private financing, starting 147 days before the election, and ending 84 days before the election;

                     (3)                     For Council candidates who are seeking public financing, starting 155 days before the election, and ending 120 days before the election; and

                     (4)                     For Council candidates who are seeking private financing, starting 119 days before the election, and ending 84 days before the election;

(C)                     Petitions gathered pursuant to the provisions of Subsection (B) shall be submitted to the City Clerk for verification every Tuesday by 12:00 p.m. during the petition gathering period.

(1)                     For Mayoral candidates seeking public financing, the final submission of petitions is due to the City Clerk no later than 5:00 p.m. 136 days before the election.

(2)                     For Mayoral candidates seeking private financing, the final submission of petitions is due to the City Clerk no later than 5:00 p.m. 84 days before the election.

(3)                     For Council candidates seeking public financing, the final submission of petitions is due to the City Clerk no later than 5:00 p.m. 120 days before the election.

(4)                     For Council candidates seeking private financing, the final submission of petitions is due no later than 5:00 p.m. 84 days before the election.

SECTION 3. COMPILATION. Sections 1 and 2 of this ordinance shall amend, be incorporated in, and made part of the City Charter and Section 2 shall amend, be incorporated in, and made part of the Revised Ordinances of Albuquerque, New Mexico, 1994.
