Adopting City Policy To Allow For The Establishment Of Parklets (Borrego, Gibson)

ADOPTING CITY POLICY TO ALLOW FOR THE ESTABLISHMENT OF PARKLETS.
WHEREAS, Parklets, also locally referred to as parquitos, are small public areas or commercial spaces supporting an adjacent business in which a curbside parking space is replaced with a seating area or gathering space that encourages additional activity along a street; Parklets may span one or more on-street parking spaces (or the equivalent curbside space); and
WHEREAS, the 2019 update to the Development Process Manual (DPM) proposes to establish policy for the development of Parklets; and
WHEREAS, the 2019 update to the DPM update has not yet been enacted; and
WHEREAS, the COVID-19 public health emergency makes the need for Parklets more immediate; and
WHEREAS, Parklets can provide adjacent retail and restaurant businesses with additional on street space for seating and other uses; and
WHEREAS, the provision of Parklets can activate the built environment by creating vibrant on street spaces; and
WHEREAS, the provision of Parklets can support the adjacent small businesses through the provision of additional outdoor space and the creation of a sense of place; and
WHEREAS, Parklets further several goals and policies within the Albuquerque/Bernalillo County Comprehensive Plan, particularly in the Transportation (Ch. 6), Urban Design (Ch. 7), and Economic Development (Ch. 8) Chapters; and
WHEREAS, Section 7-5(H)(5) of the 2019 update to the DPM establishes a definition, appropriateness, and design guidance for future Parklets; and
WHEREAS, Section 7-5(H)(5) is attached to this Resolution as Exhibit A.
BE IT RESOLVED BY THE COUNCIL, THE GOVERNING BODY OF THE CITY OF ALBUQUERQUE:
SECTION 1. The City Council hereby adopts the following attached Exhibit A as the City Policy for the establishment of Parklets, until such time as the 2019 update to the DPM is enacted.
SECTION 2. For the duration of the COVID-19 Public Health Orders (defined as Public Health Orders associated with COVID-19 that require social distancing measures, including the limitation on the occupancy of indoor spaces, as issued by the New Mexico State Governor and or the Mayor of Albuquerque.) permit fees associated with Parklets will be $0.00.
