AMENDING THE COMPOSITION OF THE GOVERNING BODY OF THE INSPIRATION PUBLIC IMPROVEMENT DISTRICT; APPROVING THE APPOINTMENT OF DIRECTORS TO THE GOVERNING BODY, PURSUANT TO THE PUBLIC IMPROVEMENT DISTRICT ACT, NMSA 1978, §§ 5-11-1 TO -27 (2001, AS AMENDED THROUGH 2019) AND CITY ENACTMENT NO. R-2020-038; AND REPEALING ALL ACTIONS INCONSISTENT WITH THIS RESOLUTION.

                     Capitalized terms used herein shall have the meanings assigned in City Enactment No. R-2020-038, adopted on April 20, 2020 (the “Formation Resolution”), except as otherwise defined in this Resolution, or unless the context clearly requires otherwise.

WHEREAS, Section 6 of the Formation Resolution, City Enactment No. R-2020-038, setup the composition of the Board based on City staff or Applicant position, but did not name specific appointees, or Treasurer and Clerk appointments; and

WHEREAS, the Department of Finance and Administrative Services/ CPA position on the Board will be replaced by a Council Services Staff member, due to availability of staff to serve; and

WHEREAS, the terms of all initial Governing Body members shall be six years. 

BE IT RESOLVED BY THE COUNCIL, THE GOVERNING BODY OF THE CITY OF ALBUQUERQUE:

Section 1.  Section 6 of City Enactment No. R-2020-038 is hereby amended as follows:

“Section 6.  District Governance

A.                     The District Board shall initially be composed of the five (5) members:

(i)                     one of whom shall be employed in the Department of Municipal Development, which member shall initially be Kevin Sourisseau;

(ii)                     one of whom shall be a certified public accountant employed in the Council Services Department, which member shall initially be Stephanie Yara;

(iii)                     one of whom shall be employed in the City Planning Department, which member shall initially be Jolene Wolfley; and

(iv)                     two members nominated by the Applicant, and consented to by the City Council, which members shall initially be David Newell and Matt Bucher;

B.                     All initial members shall serve 6-year terms.

C.                     Pursuant to NMSA 1978, § 5-11-6(A) (2019), Kevin Sourisseau is appointed to be the clerk of the District and Stephanie Yara is appointed to be treasurer of the District.

D.                     Pursuant to NMSA 1978, § 5-11-9(B) (2019), at the end of the appointed directors’ initial terms an election shall be held in conformance with the Election Code and the Local Election Act as provided in NMSA 1978, § 5-11-7 (2019) to select a new slate of directors for the District Board.”      

Section 2.  Repealer.  All ordinances or resolutions, or parts thereof in conflict with the provisions of this Resolution, are hereby repealed to the extent only of such inconsistency.  This repealer shall not be construed to revive any ordinance or resolution, or part thereof, heretofore repealed.

Section 3.  Severability.  If any section, paragraph, clause or provision of this Resolution shall for any reason be held to be invalid or unenforceable, the invalidity or unenforceability of such section, paragraph, clause or provision shall in no manner affect any remaining provisions of this Resolution.
