EXTENDING THE MORATORIUM ESTABLISHED FOR THE SECTION OF IRVING BOULEVARD FROM KAYENTA PLACE TO RIO LOS PI?OS DRIVE THROUGH DECEMBER 31ST 2020.
WHEREAS, Resolution 17-228 established a moratorium on roadway improvements for the section of Irving Boulevard from Kayenta Place to Rio Los Pi?os Drive until January 1St 2020. Road work associated with general maintenance, utility repairs and improvements or emergency safety improvements were excluded from the moratorium; and
WHEREAS, through consultation between the City Councilor to Albuquerque City Council District 5 and residents of the neighborhoods adjacent to Irving, it was determined the moratorium and accompanying exclusion should be extended a calendar year.
BE IT RESOLVED BY THE COUNCIL, THE GOVERNING BODY OF THE CITY OF ALBUQUERQUE:
Section 1. The moratorium on roadway improvements for Irving Boulevard from Kayenta Place to Rio Los Pi?os Drive is extended through December 31st 2020. Road work associated with general maintenance, utility repairs, emergency improvements and traffic calming are excluded from this moratorium.
Section 2. SEVERABILITY CLAUSE. If any section, paragraph, sentence, clause, word or phrase of this resolution is for any reason held to be invalid or unenforceable by any court of competent jurisdiction, such decision shall not affect the validity of the remaining provisions of this resolution. The Council hereby declares that it would have passed this resolution and each section, paragraph, sentence, clause, word or phrase thereof irrespective of any provisions being declared unconstitutional or otherwise invalid.
