AFFIRMING THE CITY COUNCIL’S SUPPORT OF PURSUING LEGAL ACTION AGAINST OPIOID MANUFACTURERS AND DISTRIBUTORS FOR THE OPIOID DRUG ABUSE CRISIS IN ALBUQUERQUE FUELED BY THEIR IMPROPER PROMOTION AND OVER-SUPPLY OF THOSE DRUGS.
WHEREAS, the City Council of the City of Albuquerque recognizes the epidemic of opioid drugs in the City; and
WHEREAS, it is clear from publicly available information that there exists in Albuquerque an epidemic of opioid drug abuse created and/or fueled by misconduct of opioid manufacturers and distributors in their improper promotion and over-supply of those drugs, thus creating a public nuisance within the community; and
WHEREAS, the City is empowered by law to seek recompense for its expenditures to combat the violations of law by the opioid manufactures and distributors; and
WHEREAS, the City Council agrees that legal action should be taken against the opioid manufacturers and distributors responsible for the opioid epidemic and crisis.
BE IT RESOLVED BY THE COUNCIL, THE GOVERNING BODY OF THE CITY OF ALBUQUERQUE:
The City Council supports and encourages initiating litigation against opioid manufacturers and distributors for the prosecution of all claims and causes of action relating to the opioid drug abuse crisis fueled by misconduct of opioid manufacturers and distributors due to their improper promotion and over-supply of those drugs, and directs the Administration of the City of Albuquerque to procure or otherwise select legal representation to pursue an action on behalf of the City related to these matters as soon as practicable.
