BE IT ORDAINED BY THE COUNCIL, THE GOVERNING BODY OF THE CITY OF ALBUQUERQUE:
SECTION 1. FINDINGS AND INTENT.
(A) On May 28, 2014 the City Council approved F/S O-14-10, Enactment No. O-2014-013, which amended the monthly Municipal Solid Waste Residential and Commercial Rates, and included an increase in the Residential Rate of two dollars and nine cents ($2.09) effective June 30, 2014.
(B) Approximately 64% of the Residential Rate increase approved by F/S O-14-10 was related to providing debt service capacity for the construction of a new solid waste transfer station.
(C) On December 22, 2017, City Administration announced that the City would not be constructing a solid waste transfer station at the proposed Edith Boulevard site, and that the City would explore another location for the station or the use of a decentralized model that results in less impact to the surrounding neighborhood.
(D) It is the intent of the City Council to lessen the economic burden on Residential customers related to the debt service for construction of a solid waste transfer station which has been deferred.
SECTION 2. The City hereby repeals the existing Municipal Solid Waste Collections and Disposal Rate Appendix and replaces it with the Rate Appendix attached to this Ordinance, which includes the applicable effective dates.
SECTION 3. SEVERABILITY CLAUSE. If any section, paragraph, sentence, clause, work or phrase of this ordinance is for any reason held to be invalid or unenforceable by any court of competent jurisdiction, such decision shall not affect the validity of the remaining provisions of this ordinance and each section, ...
