ESTABLISHING THAT NO NEW RECOGNIZED OR NON-RECOGNIZED NEIGHBORHOOD ASSOCIATIONS SHALL BE CREATED UNDER THE EXISTING NEIGHBORHOOD ASSOCIATION RECOGNITION ORDINANCE UNLESS IN COMPLIANCE WITH CERTAIN INTERIM PROCEDURES WHILE THE NEIGHBORHOOD ASSOCIATION RECOGNITION ORDINANCE IS UPDATED.
BE IT RESOLVED BY THE COUNCIL, THE GOVERNING BODY OF THE CITY OF ALBUQUERQUE:
SECTION 1. STATEMENT OF POLICY. The City’s Neighborhood Association Recognition Ordinance (NARO) provides a vehicle for the City to recognize neighborhood associations for the purpose of notifying associations about proposed City actions that may impact their neighborhood, including capital improvement projects and land use hearings. However, as they are currently written, the provisions of the NARO do not have the scope or enforceability mechanisms to prevent the formation of new neighborhood associations that may create discord within the community and divide neighborhoods, which is contrary to the intent of the program. As such, the Council finds that it will be necessary to update and improve the NARO and create an orderly neighborhood recognition process that guides the formation of associations that best represent their communities. As an interim step in this process, the Council finds that it is necessary for the City to temporarily stop creating new neighborhood associations under the existing NARO.
SECTION 2. INTERIM PROCEDURE. No new recognized or non-recognized neighborhood associations (hereinafter both referred to as associations) shall be established in the City unless in compliance with the following interim guidelines:
1. Proposed new associations or proposed boundary amendments to existing associations shall not overlap with existing associations;
2. Should a proposed new association or a proposed boundary expansion for an existing association contain an area that overlaps with the boundaries of an association that has been designated inactive by the Office of Neighborhood Coordination within the twelve (12) month period prior to the application of the proposed new association or boundary expansion, the inactive association shall have a period of sixty (60) days to reestablish their previous status. If the previously active association is successful in reinstating their active status, the new association’s boundaries or boundary expansion will not be allowed to include the area within the previously active association;
3. The proposed new association must adopt bylaws that, in addition to complying with Section 14-8-2-4 of the current Neighborhood Association Recognition Ordinance, in their entirety, promote an inclusive, democratic and representative association, including provisions that make the right to full membership, meeting attendance, voting, and serving on the board available to all persons residing, and to all persons and legal entities owning property or having a business within the boundaries of the proposed association.
SECTION 3. SUNSET. This resolution expires upon the sooner of the next enactment to amend the NARO in relation to the establishment of neighborhood associations or January 1, 2019.
