Approving The East Gateway Metropolitan Redevelopment Area Plan (Harris)

APPROVING THE EAST GATEWAY METROPOLITAN REDEVELOPMENT AREA PLAN.

WHEREAS, the New Mexico Legislature has passed the Metropolitan Redevelopment Code (herein “Code”), Sections 3-60A-1 to 3-60A-48 inclusive NMSA, 1978, as amended, which authorizes the City of Albuquerque, New Mexico (the “City”) to prepare metropolitan redevelopment plans and to undertake and carry out metropolitan redevelopment projects; and

WHEREAS, the City Council, the governing body of the City, (the “City Council”) after notice and public hearing as required by Code, has duly passed and adopted Council Resolution F/S R-07-275, which designated the East Gateway Area as a Metropolitan Redevelopment Area (MRA), and established its boundaries; and

WHEREAS, the City Council, after notice and public hearing as required by Code, subsequently amended that boundary and directed the Metropolitan Redevelopment Agency to prepare a Metropolitan Redevelopment Plan for the East Gateway Metropolitan Redevelopment Area, as expanded, through the adoption of City Council Resolution R-11-298; and

WHEREAS, these Resolutions made certain findings, among other things, declaring the East Gateway Metropolitan Redevelopment Area to be blighted and that rehabilitation, conservation, development and redevelopment in the East Gateway area is necessary in the interest of public health, safety, morals and welfare of the residents of the City; and

                     WHEREAS, the Albuquerque Development Commission, which acts as the Metropolitan Redevelopment Commission under the provisions of §14-8-4-1 ROA 1994, (the “Commission”) recommends approval of the East Gateway Metropolitan Redevelopment Plan (the “Plan”) for the redevelopment of the area, as required by the Code; and

                     WHEREAS, the City Council has conducted a public hearing, after proper notice as required by the Code, on the Plan; and

                     WHEREAS, the East Gateway Metropolitan Redevelopment Plan proposes projects and partnerships that will help spur redevelopment of underutilized and/or dilapidated sites within the project area; and

                     WHEREAS, the East Gateway Metropolitan Redevelopment Plan identifies multiple strategies for revitalization of the area, including improvements to streetscapes and public facilities, partnerships with property owners with transit-oriented development to support proposed Bus Rapid Transit service in the area, installation of public art to beautify and help create an identity for the area, and safety improvements such as pedestrian lighting; and

                     WHEREAS, the Plan proposes the design and construction of iconic signs enticing motorists to explore the area’s rich Route 66 history and architecture  and to visit local attractions like the National Museum of Nuclear Science and History; and

                     WHEREAS, the Plan proposes coordinated redevelopment of underutilized or vacant properties in the area, ranging from partnership with property owners for infrastructure upgrades and other projects that help lower redevelopment costs to direct acquisition and redevelopment of properties where applicable and prudent; and

                     WHEREAS, this Metropolitan Redevelopment Area Plan for projects will promote the local health, general welfare, safety, convenience and prosperity of the inhabitants of the City and will benefit the City’s effort to revitalize the area.

BE IT RESOLVED BY THE COUNCIL, THE GOVERNING BODY OF THE CITY OF ALBUQUERQUE:

                     SECTION 1. The City Council, after having conducted a public hearing pursuant to the code, finds that:

                                          A.  The proposed redevelopment of the East Gateway Metropolitan Redevelopment Area will aid in the elimination and prevention of blight or conditions which lead to development of blight.

                                          B.  The East Gateway Metropolitan Redevelopment Plan does not require the relocation of any families or individuals from their dwellings; therefore, a method for providing relocation assistance is not required.

                                          C.  The East Gateway Metropolitan Redevelopment Plan complements the Albuquerque/Bernalillo County Comprehensive Plan and affords maximum opportunity consistent with the needs of the community for the rehabilitation and redevelopment of the East Gateway Metropolitan Redevelopment Area by public activities and private enterprise; and the objectives of the Plan justify the proposed activities as public purposes and needs.

                                          D.  The East Gateway Metropolitan Redevelopment Area Plan, attached as Exhibit A, and made a part hereof, is approved in all respects.

                     SECTION 2.  SEVERABILITY CLAUSE.  If any section, paragraph, sentence, clause, word or phrase of this resolution is for any reason held to be invalid or unenforceable by any court of competent jurisdiction, such decision shall not affect the validity of the remaining provisions of this resolution.  The Council hereby declares that it would have passed this resolution and each section, paragraph, sentence, clause, word or phrase thereof irrespective of any provisions being declared unconstitutional or otherwise invalid.
