DIRECTING THE ALBUQUERQUE POLICE DEPARTMENT TO MAINTAIN A SEPARATE ACCOUNTING OF EXPENDITURES RELATED TO THE IMPLEMENTATION OF THE U.S. DEPARTMENT OF JUSTICE REFORM RECOMMENDATIONS AND REQUIRING QUARTERLY REPORTING OF THE EXPENDITURES TO THE CITY COUNCIL.
WHEREAS, The U.S. Department of Justice (DOJ) conducted a civil investigation of the Albuquerque Police Department (APD) which focused on allegations of use of excessive force by APD officers; and
WHEREAS, The DOJ, in its letter dated April 10, 2014, found reasonable cause to believe that APD engages in a pattern or practice of use of excessive force in violation of the Fourth Amendment, and that structural and systemic deficiencies within APD contribute to the use of unreasonable force; and
WHEREAS, On November 10, 2014, the City entered into a settlement agreement with the DOJ which will guide the implementation of reforms within APD in nine key areas; and
WHEREAS, C/S R-14-47 included an appropriation to APD of $1,000,000 and a General Fund reserve of $1,000,000 in fiscal year 2015 for the implementation of the DOJ recommendations; and
WHEREAS, It will be necessary for the City Council to appropriate additional funding for implementation of the DOJ recommendations in future fiscal years.
BE IT RESOLVED BY THE COUNCIL, THE GOVERNING BODY OF THE CITY OF ALBUQUERQUE:
