ESTABLISHING A POLICY FOR THE TIMEFRAMES FOR PURGING OF LICENSE PLATE READER RECORDS BY THE ALBUQUERQUE POLICE DEPARTMENT.
      WHEREAS, the Albuquerque Police Department employs license plate readers that record a still image of vehicle license plates and location information from vehicles parked or driving in public locations; and
      WHEREAS, certain license plate images and location data may be of use in legitimate police activity including but not limited to the detection of missing persons and stolen vehicles; and
      WHEREAS, the license plate images are in a format that allows storage and archiving of the images for indefinite periods of time; and
      WHEREAS, in addition to its interests and responsibilities in the detection and prevention of crime, the City has a legitimate interest in protecting the privacy of private citizens driving and parking in public places but not involved in any criminal activity.
BE IT RESOLVED BY THE COUNCIL, THE GOVERNING BODY OF THE CITY OF ALBUQUERQUE:
      Section 1. It shall be the policy of the City that the Albuquerque Police Department shall purge each license plate image and all associated information from its databases within fourteen (14) days from the date of collection unless a longer period of retention is required for a particular license plate image, images or information because of an ongoing criminal investigation.
