rgin-left: 18pt;line-height: 150%;text-indent:18pt;">WHEREAS, the American Recovery and Reinvestment Act (ARRA) of 2009 authorized Section 5307 funding for public transportation projects in the Albuquerque urbanized area; and
rgin-left: 18pt;line-height: 150%;text-indent:18pt;">WHEREAS, the Administrator of the Federal Transit Administration (FTA) has been delegated the authority by the Secretary of the U. S. Department of Transportation to make grants for the ARRA apportioned funding; and
rgin-left: 18pt;line-height: 150%;text-indent:18pt;">WHEREAS, Council Bill No. O-07-89 established procedures for the inclusion and amendment of projects in the Transportation Improvement Program (TIP) that require City Council resolution for TIP amendments; and
rgin-left: 18pt;line-height: 150%;text-indent:18pt;">WHEREAS, Council Bill No. F/S R-07-210, which listed projects for inclusion in the 2008 - 2013 Transportation Improvement Program (TIP), needs to be updated to reflect this new source of funds and related projects; and
rgin-left: 18pt;line-height: 150%;text-indent:18pt;">WHEREAS, the following public transportation projects are in need of Section 5307 ARRA federal funding: transit kiosks, fare boxes and related technologies, and prefabricated shelters and maintenance support vehicles for bus stops; and
rgin-left: 18pt;line-height: 150%;text-indent:18pt;"> WHEREAS, the Secretary of the U.S. Department of Transportation has made available to the City of Albuquerque federal funding in the total amount of $11,388,245 for these projects; and
rgin-left: 18pt;line-height: 150%;text-indent:18pt;">WHEREAS, these federal funds do not require local matching funds; and
rgin-left: 18pt;line-height: 150%;text-indent:0pt;">      WHEREAS, it is required by the U.S. Department of Transportation in accordance with the provisions of Title VI of the Civil Rights Act of 1964 that in connection with filing for assistance under 49 U.S.C. 5307 that the applicant gives assurances that it will comply with Title VI of the Civil Rights Act of 1964 and related U.S. Department of Transportation requirements.
rgin-left: 18pt;line-height: 150%;text-indent:0pt;">BE IT RESOLVED BY THE COUNCIL, THE GOVERNING BODY OF THE CITY OF ALBUQUERQUE:
rgin-left: 18pt;line-height: 150%;text-indent:18pt;">Section 1.  That the Mayor is authorized to file, execute and provide additional information as necessary related to grant applications on behalf of the City of Albuquerque with the U.S. Department of Transportation to aid in the financing of transit projects pursuant to 49 U.S.C. 5307.
rgin-left: 18pt;line-height: 150%;text-indent:18pt;">Section 2.  That the ARRA grant in the total amount of $11,388,245 consisting of $225,000 for the acquisition and installation of stationary fare collection equipment (kiosks) and related structural improvements; $1,355,000 for the acquisition and installation of fare boxes and related technologies; and $9,808,245 for the rehabilitation, upgrade and/or construction of bus stops and the acquisition of related equipment including maintenance support vehicles and prefabricated shelters is hereby approved and the submission and filing with the appropriate official or office of the Federal Transit Administration (FTA) is in all respects approved.
rgin-left: 18pt;line-height: 150%;text-indent:0pt;">      Section 3.       That the 2008 - 2013 TIP is hereby amended to include these proposed projects for FTA 5307 Economic Recovery funding in Fiscal year 2009.
rgin-left: 18pt;line-height: 150%;text-indent:18pt;">Section 4.  That the following amounts are hereby appropriated to Fund 306 ARRA for the Transit Department as indicated below:
